The brief argues that the Constitution prohibits pre-viability abortion bans because the right to decide to end a pregnancy is critical to the liberty and equality guaranteed by the Fourteenth Amendment. This is a right that remains critical, notwithstanding advances in gender equality.
Amici explain how the Mississippi abortion ban would impede women’s ability to participate equally in society by harming economic security, equality, and opportunity, and have particularly detrimental effects on marginalized groups.
