Constitutional Scholars Amicus Brief
Amici are constitutional law scholars writing in support of the United States. Amici argue that Texas’s transparent scheme to evade judicial review of S.B. 8 represents an exceptional circumstance that the United States has standing to challenge. Amici further argue that the law is an unprecedented attack on the Supremacy Clause and the Framers’ constitutional design. One that, if allowed to stand, would lead to constitutional rights of all kinds to be subject to intimidation and denial.

This brief was filed in support of the United States in United States v. Texas, a lawsuit at the U.S. Supreme Court challenging Texas’s abortion ban (S.B. 8).
