Associated Press: Nebraska lawmaker seeks abortion restrictions

“Nebraska lawmakers could become the first in the country to attempt to use a 2007 U.S. Supreme Court decision to ban second trimester and late-term abortions based on assertions that some fetuses experience pain during the procedure. Janet Crepps of the Center for Reproductive Rights said they haven’t gone as far as the Nebraska lawmaker is proposing because there clearly isn’t the legal latitude to do so. ‘The Supreme Court has drawn a clear line between requiring women to receive certain information and telling them they can’t have abortions before viability,’ Crepps said. Viability of a fetus is determined on a case-by-case basis. Crepps said she didn’t think there was a clear scientific answer to whether they experience pain, and Carhart said he was sure they don’t.”
