Mali’s Abortion Provisions

PARAGRAPHE IV: DE L’ AVORTEMENT

ARTICLE 211: Il est interdit tout avortement qui consiste dans l’emploi de moyens ou de substances en vue de provoquer l’expulsion prématurée du foetus, quel que soit le moment de la grossesse où cette expulsion est pratiquée pour tout motif autre que la sauvegarde de la vie de la femme.

Hormis les cas pratiqués pour motif thérapeutique, l’avortement ci dessus caractérisé volontairement tenté ou obtenu de quelque manière que ce soit, soit par la femme, soit par un tiers meme avec son consentement, sera puni de un à cinq ans d’emprisonnement et facultativement de 20 000 à 1 000 000 de francs d’amende et de un à dix ans d’interdiction de séjour.

ARTICLE 212: Les médecins, officiers de santé, sages-femmes, chirurgiens, dentistes, pharmaciens, ainsi que les étudiants ou employés en pharmacie, herboristes bandagistes, marchands d’instruments de chirurgie, infirmiers, masseurs, qui auront indiqué, favorisé ou pratiqué les moyens de procurer l’avortement ainsi défini à l’article précédent, seront condamnés aux peines prévues à l’article 213. La suspension pendant cinq ans au moins ou l’incapacité absolue de l’exercice de leur profession pourra être, en outre prononcée contre les coupables.

Quiconque contrevient à l’interdiction d’exercer sa profession prononcée en vertu de l’alinéa précédent sera puni d’un emprisonnement de six mois au moins, de deux ans au plus et d’une amende de 20 000 francs au moins et 1 200 000 francs au plus ou de l’une de ces deux peines seulement.

PARAGRAPHE V : DU TRAITEMENT D’ EPREUVES ET AUTRES PRATIQUES NUISIBLES A LA SANTE

ARTICLE 213: Quiconque, sans intention coupable, aura administré volontairement à une personne des substances ou se sera livré sur elle, même avec son consentement, à des pratiques ou manoeuvres qui auront déterminé ou auraient pu déterminer une maladie ou une incapacité de travail, sera puni de six mois à trois ans d’emprisonnement et facultativement de 20.000 à 200.000 francs d’amende et de un à dix ans d’interdiction de séjour.

S’il en résulte une maladie ou une incapacité permanente, la peine sera de cinq à dix ans de réclusion. L’interdiction de séjour de cinq à dix ans pourra être prononcée.

Si la mort s’en est suivie, la peine sera de cinq à vingt ans de réclusion et facultativement, de un à vingt ans d’interdiction de séjour.

Article 13: L’interruption volontaire de la grossesse ne saurait en aucun cas être considéré comme une méthode contraceptive.

Il est interdit tout avortement qui consiste dans l’emploi de moyens ou de substances en vue de provoquer l’expulsion prématurée du fœtus, quel que soit le moment de la grossesse où cette expulsion est pratiquée par tout motif autre que:

– la sauvegarde de la vie de la femme enceinte,

– lorsque la grossesse est la conséquence établie d’un viol ou d’une relation incestueuse, à la demande expresse de la femme enceinte.

PARAGRAPH IV: ABORTION

ARTICLE 211: Any abortion that consists of the use of means or substances in order to provoke the premature expulsion of a fetus, whatever the moment of pregnancy, when this expulsion is practiced for any reason other than saving the life of the woman, is prohibited.

Except in the cases practiced for a therapeutic reason, an abortion, as characterized above, voluntarily attempted or obtained in any manner whatever by the woman or by a third person even with her consent, shall be punished with imprisonment of one to five years and optionally a fine of 20,000 to 1,000,000 francs and a ban on residence of one to ten years.

ARTICLE 212: Physicians, health officers, midwives, surgeons, dentists, and pharmacists, as well pharmacy students or employees, herbalists, medical store personnel, sellers of surgical instruments, nurses, and masseurs, who have indicated, promoted, or practiced means of procuring abortion as defined in the preceding article, shall be convicted of the penalties provided for in article 213. A suspension for five years at least or an absolute ban from exercising their profession may, as well, be ordered against the guilty persons.

Whoever contravenes the ban on exercising his/her profession ordered pursuant to the preceding paragraph shall be punished with imprisonment of six months at least to two years at most and/or a fine of 20,000 francs at the least and 1,200,000 francs at the most.

PARAGRAPH V: THE HANDLING OF TESTS AND OTHER PRACTICES HARMFUL TO HEALTH

ARTICLE 213: Whoever, without criminal intent, has voluntarily administered substances to a person or engaged in practices or operations with respect to him/her, even with his/her consent, that have caused or could cause an illness or incapacity to work shall be punished with imprisonment of six months to three years and optionally with a fine of 20,000 to 200,000 francs and a ban on residence of one to ten years.

If it results in a permanent illness or incapacity, the penalty shall be imprisonment of five to ten years. A ban on residence of five to ten years may be ordered.

If death results, the punishment shall be imprisonment of five to twenty years and optionally a ban on residence of twenty years.

Article 13: Voluntary interruption of pregnancy shall in no case be considered as a contraceptive method.

Any abortion that consists of the use of means or substances in order to provoke the premature expulsion of a fetus, whatever the moment of pregnancy, when this expulsion is practiced is prohibited for any reason other than:

– saving the life of the pregnant woman,

– when the pregnancy is the established consequence of rape or an incestuous relationship, at the express request of the pregnant woman.
