Esterilizaciones Forzadas En Perú: Luego De 18 Años De Proceso Penal Se Abre Investigación Judicial Contra Alberto Fujimori Y Sus Exministros De Salud

La decisión de la justicia peruana y la lucha de las víctimas representa una oportunidad para la búsqueda de verdad, justicia y reparación. Más de 217 mil mujeres fueron esterilizadas entre 1996 y 1998 en el Perú. La investigación judicial activa el proceso contra Alberto Fujimori, Eduardo Yong Motta, Marino Costa Bauer y Alejandro Aguinaga actual congresista de la república.

Lima, Perú. Diciembre 16 de 2021 – Estudio para la Defensa de la Mujer (DEMUS), el Comité de América Latina y el Caribe para la Defensa de los Derechos Humanos de la Mujer (CLADEM), la Asociación Pro Derechos Humanos (APRODEH), el Centro de Derechos Reproductivos (CDR) y el Centro por la justicia y el Derecho Internacional (CEJIL), organizaciones representantes ante el Sistema Interamericano de derechos humanos de la víctima Maria Mamerita Mestanza y su familia, celebran la decisión de abrir la investigación judicial contra las máximas autoridades políticas por las esterilizaciones forzadas de miles de mujeres en Perú. 

Esta grave violación a los derechos humanos se dio bajo el gobierno de Alberto Fujimori, como una política de carácter masivo, compulsivo y sistemático que consistió en impedir especialmente la reproducción de mujeres pobres, indígenas y de zonas rurales del Perú en los procedimientos de esterilización, vulnerando su derecho a la planificación familiar y el consentimiento previo, libre, informado y por escrito. A la fecha se conoce que durante la vigencia del programa entre los años 1996 y 1998, más de 217 mil mujeres fueron esterilizadas sin garantizar sus derechos humanos. Entre las víctimas se encontraba la señora Mamerita Mestanza, quien falleció el 5 de abril de 1998, y cuya familia decidió junto a las organizaciones ya mencionadas presentar su caso en 1999 ante la Comisión Interamericana de Derechos Humanos (CIDH). 

En el marco del proceso, en 2003 las víctimas y sus representantes firmaron de buena voluntad un acuerdo de solución amistosa ante la CIDH con el Estado peruano, donde se prevén medidas de reparación integral. Al día de hoy, pasados 18 años de la firma del acuerdo, gran parte de dichas medidas, tales como la condena a todas las personas responsables, el acceso a reparación en educación y las medidas para que estos hechos no vuelvan a ocurrir siguen pendientes de cumplimiento.

“Es por eso que este paso dado por la justicia peruana y la incansable lucha de las víctimas representa una oportunidad de esperanza en la búsqueda de verdad, justicia y reparación para miles de víctimas, sobrevivientes y los familiares de Mamerita Mestanza, Celia Ramos y tantas otras,” señaló Milton Campos abogado de Demus.

“Es una oportunidad para el reconocimiento del deber del Estado peruano de garantizar los derechos sexuales y derechos reproductivos como derechos humanos, ya que la violencia sexual incluida las esterilizaciones forzadas como política de Estado en el Perú de los 90 es un crimen de lesa humanidad que no debe quedar impune,” agrego la abogada de Demus María Ysabel Cedano. 

En el camino a seguir, es necesario un compromiso serio e idóneo por parte del Poder Judicial y Ministerio Público de Perú. Así, la investigación judicial podrá ser hecha con la debida diligencia reforzada y en plazo razonable, concluir en acusación para ir a juicio oral y por fin, obtener sentencia condenatoria. Desde las organizaciones que acompañamos el proceso a nivel internacional nos mantendremos atentas a este proceso judicial y continuaremos informando a la CIDH para asegurar que la investigación pueda llevarse adelante, de ahora en más, de manera diligente y adecuada.
