En Chile Regularmente Se Abusa De Las Mujeres VIH Positivas En Los Servicios Médicos

Entre otros abusos, el informe del Centro de Derechos Reproductivos y de Vivo Positivo documenta la esterilización forzada, los abusos verbales y la denegación de servicios

Nueva York – El día de hoy, el Centro de Derechos Reproductivos y la organización chilena para la prestación de servicios a las personas que viven con VIH/SIDA, Vivo Positivo, hicieron público el resultado de una reciente investigación en derechos humanos en la que se constata que en Chile, los profesionales de la salud con frecuencia abusan de las mujeres VIH positivas, llegando hasta esterilizarlas en el transcurso de otros procedimientos médicos sin que ellas lo sepan ni presten su consentimiento. Según el reporte “Dignity Denied: Violations of the Rights of HIV-Positive Women in Chilean Health Facilities”, el Estado chileno ha fallado en proteger los derechos humanos de las mujeres que viven con VIH/SIDA en el país, propiciando una atmósfera en la que los trabajadores de la salud las discriminan intencionalmente.“Cuando el Estado permite que los profesionales médicos discriminen a las pacientes que viven con VIH/SIDA sin que esto tenga repercusiones, se las está tratando esencialmente como seres humanos inferiores, despojándolas de su dignidad”, declaró Luisa Cabal, Directora del Programa Legal Internacional del Centro de Derechos Reproductivos.La mala información y los equívocos en torno al riesgo de transmisión del VIH son comunes en Chile y alimentan el trato discriminatorio. Por ejemplo, a pesar del bajo riesgo de la transmisión madre a hijo del VIH/SIDA con las intervenciones adecuadas y el hecho de que en Chile está regulada la prevención de este tipo de transmisión, los profesionales de la salud regañan a las mujeres VIH positivas por haberse embarazado y las presionan para que no se embaracen. Además, a las mujeres que viven con VIH/SIDA que acuden a los servicios de salud reproductiva con frecuencia se les niega la atención, se les da información engañosa e incompleta, y se les viola su derecho a mantener la confidencialidad de su historia clínica cuando el personal médico revela inadvertidamente su condición seropositiva a miembros de la familia o a otros pacientes.“Toda mujer tiene derecho al acceso a la atención médica de su salud sin discriminación, coerción ni violencia. Ya es hora de que el gobierno chileno proteja estos derechos”, dijo Lilian Sepúlveda, Directora Adjunta del Programa Legal Internacional y Coordinadora , Regional para América Latina y el Caribe en el Centro de Derechos Reproductivos.Entre otras recomendaciones, el reporte insta al Estado Chileno a que desarrolle estrategias efectivas para que se implementen la legislación vigente y los compromisos internacionales sobre derechos de las mujeres, y garantice que los proveedores de la salud estén adecuadamente capacitados en transmisión del VIH/SIDA, mejores prácticas y derechos de las pacientes.El año pasado, el Centro de Derechos Reproductivos y Vivo Positivo presentaron una demanda a Chile en nombre de una mujer con VIH/SIDA que fue esterilizada sin su consentimiento después de dar a luz. La demanda sostiene que Chile violó el derecho de F.S.* a no sufrir discriminación, así como su derecho a decidir el número e intervalo de hijos, el derecho a no ser objeto de violencia y al libre acceso a la justicia. El caso F.S. v. Chile se presentó ante la Comisión Interamericana de Derechos Humanos, un organismo internacional de derechos humanos. La Comisión Interamericana, con sede en Washington, D.C., vigila el cumplimiento por parte de los Estados miembros de los tratados regionales de derechos humanos, como lo son la Convención Americana de Derechos Humanos y la Convención Interamericana para , Prevenir, Sancionar y Erradicar la Violencia contra las Mujer. El Estado chileno ha ratificado estos tratados, lo cual significa que está obligado a respetar, proteger y garantizar los derechos humanos fundamentales que éstos reconocen. ,*Se ha cambiado el nombre para proteger la identidad de la persona.
