Colombia: El derecho a recibir información veraz e imparcial.


En los próximos días la Corte Constitucional de Colombia debe decidir un caso alrededor del derecho fundamental de las mujeres a recibir
información sobre su salud sexual y reproductiva. En mayo de este año el Centro de Derechos Reproductivos presentó una intervención
ciudadana ante la Corte Constitucional en un caso presentado por Women’s Link Worldwide (WLW), una organización internacional de derechos humanos que
trabaja por la igualdad de género. Hacia finales de 2011 WLW presentó una tutela (un mecanismo legal para la
protección inmediata de derechos fundamentales) contra la Procuraduría General de la Nación (órgano de control, encargado de garantizar
la efectividad de los derechos fundamentales) por publicar información falsa y parcial sobre derechos sexuales y reproductivos. La tutela fue firmada por 1201 mujeres. WLW alega
que este hecho viola el derecho a la información respecto de la salud reproductiva y amenaza otros derechos humanos. El 31 de enero de 2012 la Corte
Constitucional seleccionó la tutela de WLW para revisión.



El Centro de Derechos Reproductivos preparó una intervención ciudadana para coadyuvar a los argumentos presentados por WLW, en defensa de los
derechos reproductivos de las mujeres, que fue radicada ante la Corte Constitucional el 10 de mayo. La intervención argumenta que las acciones del
Procurador General de la Nación y dos de sus Procuradoras Delegadas

comprometen el cumplimiento del Estado colombiano con las obligaciones internacionales de derechos humanos que ha contraído mediante la
ratificación de tratados internacionales.



La intervención alega que los funcionarios públicos mencionados han comprometido la salud y el bienestar de las mujeres por varias razones:



  • Publicaron información que distorsiona la verdad acerca del marco legal sobre la
    despenalización del aborto, así como sobre los efectos de la anticoncepción de emergencia y el misoprostol, un medicamento utilizado para la
    práctica de abortos médicos. La legislación nacional y la jurisprudencia de la Corte Constitucional colombiana obligan al Estado a poner a
    disposición de los ciudadanos información basada en hechos.



  • Violaron la obligación de transparencia activa en cabeza del Estado -de suministrar de manera
    completa la información que sea necesaria para el ejercicio de otros derechos, establecida por los estándares internacionales de derechos
    humanos.





  • Violaron el derecho a la información de las mujeres, específicamente en cuanto a su salud, lo que equivale a una violación del
    derecho a la salud.

    Esta violación amenaza el cumplimiento de otros aspectos del derecho a la salud, y consecuentemente los derechos a la vida, la integridad y la
    igualdad.



El Centro se une a WLW para instar a la Corte Constitucional colombiana a que proteja los derechos humanos que han sido violados o amenazados
por la información parcial publicada por funcionarios de la Procuraduría General de la Nación. Instamos a la Corte a que delimite las
responsabilidades de los servidores públicos en cuanto a la garantía de los derechos sexuales y reproductivos de las mujeres, especialmente en lo
que se refiere a la emisión pública de información al respecto, y que esas responsabilidades incluyan la de publicar únicamente
información veraz e imparcial que beneficie la salud y la dignidad de todas las mujeres colombianas. ,
