Biden-Harris Administration Issues Proposed Rule to Strengthen Nondiscrimination Protections in Health Care
07.26.2022 — On Monday July 25th, the Biden-Harris administration issued a proposed rule implementing Section 1557 of the Affordable Care Act, which would restore and strengthen vital nondiscrimination protections in health care.
Section 1557 of the Affordable Care Act prohibits discrimination on the basis of race, color, national origin, sex, age, and disability in health programs and activities receiving federal financial assistance. It is the first federal civil rights law to prohibit sex discrimination in health care. The Trump administration sought to undermine these vital nondiscrimination protections and harm access to health care for women, LGBTQI+ people, Black, Indigenous, and other People of Color, immigrants, and people with disabilities.
Statement from Nancy Northup, President & CEO of the Center for Reproductive Rights:
“Everyone deserves access to the health care they need, free from discrimination. The Biden-Harris administration’s proposed rule is an important first step towards ensuring that goal.
At a time when we’re seeing unprecedented attacks on reproductive rights and trans rights, now more than ever people seeking access to care need strong nondiscrimination protections.
We are encouraged to see the Biden-Harris administration demonstrating their continued commitment to furthering health equity and look forward to engaging in the rulemaking process.”
