Livre II : Interruption volontaire de grossesse
Titre Ier : Dispositions générales
Chapitre Ier: Principe général.
Article L2211-1
Comme il est dit à l’article 16 du code civil ci-après reproduit :
“La loi assure la primauté de la personne, interdit toute atteinte à la dignité de celle-ci et garantit le respect de l’être humain dès le commencement de sa vie.”
Article L2211-2
Il ne saurait être porté atteinte au principe mentionné à l’article L. 2211-1 qu’en cas de nécessité et selon les conditions définies par le présent titre.
L’enseignement de ce principe et de ses conséquences, l’information sur les problèmes de la vie et de la démographie nationale et internationale, l’éducation à la responsabilité, l’accueil de l’enfant dans la société et la politique familiale sont des obligations nationales. L’Etat, avec le concours des collectivités territoriales, exécute ces obligations et soutient les initiatives qui y contribuent.
Chapitre II: Interruption pratiquée avant la fin de la douzième semaine de grossesse.
Article L2212-1
Toute femme qui ne veut pas poursuivre sa grossesse pourrait obtenir l’IVG, sa décision n’étant liée à aucune difficulté particulière. Cette interruption ne peut être pratiquée qu’avant la fin de la douzième semaine de grossesse.
Article L2212-2
L’interruption volontaire d’une grossesse ne peut être pratiquée que par un médecin.
Elle ne peut avoir lieu que dans un établissement de santé, public ou privé, ou dans le cadre d’une convention conclue entre le praticien ou un centre de planification ou d’éducation familiale ou un centre de santé et un tel établissement, dans des conditions fixées par décret en Conseil d’Etat.
Article L2212-3
Le médecin sollicité par une femme en vue de l’interruption de sa grossesse doit, dès la première visite, informer celle-ci des méthodes médicales et chirurgicales d’interruption de grossesse et des risques et des effets secondaires potentiels.
Il doit lui remettre un dossier-guide, mis à jour au moins une fois par an, comportant notamment le rappel des dispositions des articles L. 2212-1 et L. 2212-2, la liste et les adresses des organismes mentionnés à l’article L. 2212-4 et des établissements où sont effectuées des interruptions volontaires de la grossesse.
Les agences régionales de santé assurent la réalisation et la diffusion des dossiers-guides destinés aux médecins.
Article L2212-4
Il est systématiquement proposé, avant et après l’interruption volontaire de grossesse, à la femme majeure une consultation avec une personne ayant satisfait à une formation qualifiante en conseil conjugal ou toute autre personne qualifiée dans un établissement d’information, de consultation ou de conseil familial, un centre de planification ou d’éducation familiale, un service social ou un autre organisme agréé. Cette consultation préalable comporte un entretien particulier au cours duquel une assistance ou des conseils appropriés à la situation de l’intéressée lui sont apportés.
Pour la femme mineure non émancipée, cette consultation préalable est obligatoire et l’organisme concerné doit lui délivrer une attestation de consultation. Si elle exprime le désir de garder le secret à l’égard des titulaires de l’autorité parentale ou de son représentant légal, elle doit être conseillée sur le choix de la personne majeure mentionnée à l’article L. 2212-7 susceptible de l’accompagner dans sa démarche.
Les personnels des organismes mentionnés au premier alinéa sont soumis aux dispositions des articles 226-13 et 226-14 du code pénal.
Chaque fois que cela est possible, le couple participe à la consultation et à la décision à prendre.
Article L2212-5
Si la femme renouvelle, après les consultations prévues aux articles L. 2212-3 et L. 2212-4, sa demande d’interruption de grossesse, le médecin doit lui demander une confirmation écrite; il ne peut accepter cette confirmation qu’après l’expiration d’un délai d’une semaine suivant la première demande de la femme, sauf dans le cas où le terme des douze semaines risquerait d’être dépassé. Cette confirmation ne peut intervenir qu’après l’expiration d’un délai de deux jours suivant l’entretien prévu à l’article L. 2212-4, ce délai pouvant être inclus dans celui d’une semaine prévu ci-dessus.
Article L2212-6
En cas de confirmation, le médecin peut pratiquer lui-même l’interruption de grossesse dans les conditions fixées au deuxième alinéa de l’article L. 2212-2. S’il ne pratique pas lui-même l’intervention, il restitue à la femme sa demande pour que celle-ci soit remise au médecin choisi par elle et lui délivre un certificat attestant qu’il s’est conformé aux dispositions des articles L. 2212-3 et L. 2212-5.
Le directeur de l’établissement de santé dans lequel une femme demande son admission en vue d’une interruption volontaire de la grossesse doit se faire remettre et conserver pendant au moins un an les attestations justifiant qu’elle a satisfait aux consultations prescrites aux articles L. 2212-3 à L. 2212-5.
Article L2212-7
Si la femme est mineure non émancipée, le consentement de l’un des titulaires de l’autorité parentale ou, le cas échéant, du représentant légal est recueilli. Ce consentement est joint à la demande qu’elle présente au médecin en dehors de la présence de toute autre personne.
Si la femme mineure non émancipée désire garder le secret, le médecin doit s’efforcer, dans l’intérêt de celle-ci, d’obtenir son consentement pour que le ou les titulaires de l’autorité parentale ou, le cas échéant, le représentant légal soient consultés ou doit vérifier que cette démarche a été faite lors de l’entretien mentionné à l’article L. 2212-4.
Si la mineure ne veut pas effectuer cette démarche ou si le consentement n’est pas obtenu, l’interruption volontaire de grossesse ainsi que les actes médicaux et les soins qui lui sont liés peuvent être pratiqués à la demande de l’intéressée, présentée dans les conditions prévues au premier alinéa. Dans ce cas, la mineure se fait accompagner dans sa démarche par la personne majeure de son choix.
Après l’intervention, une deuxième consultation, ayant notamment pour but une nouvelle information sur la contraception, est obligatoirement proposée aux mineures.
Article L2212-8
Un médecin n’est jamais tenu de pratiquer une interruption volontaire de grossesse mais il doit informer, sans délai, l’intéressée de son refus et lui communiquer immédiatement le nom de praticiens susceptibles de réaliser cette intervention selon les modalités prévues à l’article L. 2212-2.
Aucune sage-femme, aucun infirmier ou infirmière, aucun auxiliaire médical, quel qu’il soit, n’est tenu de concourir à une interruption de grossesse.
Un établissement de santé privé peut refuser que des interruptions volontaires de grossesse soient pratiquées dans ses locaux.
Toutefois ce refus ne peut être opposé par un établissement mentionné au 2° de l’article L. 6161-5 ou par un établissement ayant conclu un contrat de concession en application de l’article L. 6161-9 dans sa rédaction antérieure à la loi n° 2009-879 du 21 juillet 2009 portant réforme de l’hôpital et relative aux patients, à la santé et aux territoires que si d’autres établissements sont en mesure de répondre aux besoins locaux.
Les catégories d’établissements publics qui sont tenus de disposer des moyens permettant la pratique des interruptions volontaires de la grossesse sont fixées par décret.
Article L2212-9
Tout établissement dans lequel est pratiquée une interruption de grossesse doit assurer, après l’intervention, l’information de la femme en matière de régulation des naissances.
Article L2212-10
Toute interruption de grossesse doit faire l’objet d’une déclaration établie par le médecin et adressée par l’établissement où elle est pratiquée au médecin de l’agence régionale de santé désigné par le directeur général de l’agence; cette déclaration ne fait aucune mention de l’identité de la femme.

Les conditions d’application du présent chapitre sont déterminées par décret en Conseil d’Etat.

Chapitre III: Interruption de grossesse pratiquée pour motif medical.
Article L2213-1
L’interruption volontaire d’une grossesse peut, à toute époque, être pratiquée si deux médecins membres d’une équipe pluridisciplinaire attestent, après que cette équipe a rendu son avis consultatif, soit que la poursuite de la grossesse met en péril grave la santé de la femme, soit qu’il existe une forte probabilité que l’enfant à naître soit atteint d’une affection d’une particulière gravité reconnue comme incurable au moment du diagnostic.
Lorsque l’interruption de grossesse est envisagée au motif que la poursuite de la grossesse met en péril grave la santé de la femme, l’équipe pluridisciplinaire chargée d’examiner la demande de la femme comprend au moins quatre personnes qui sont un médecin qualifié en gynécologie-obstétrique, membre d’un centre pluridisciplinaire de diagnostic prénatal, un praticien spécialiste de l’affection dont la femme est atteinte, un médecin choisi par la femme et une personne qualifiée tenue au secret professionnel qui peut être un assistant social ou un psychologue. Le médecin qualifié en gynécologie-obstétrique et le médecin qualifié dans le traitement de l’affection dont la femme est atteinte doivent exercer leur activité dans un établissement de santé.
Lorsque l’interruption de grossesse est envisagée au motif qu’il existe une forte probabilité que l’enfant à naître soit atteint d’une affection d’une particulière gravité reconnue comme incurable au moment du diagnostic, l’équipe pluridisciplinaire chargée d’examiner la demande de la femme est celle d’un centre pluridisciplinaire de diagnostic prénatal. Lorsque l’équipe du centre précité se réunit, un médecin choisi par la femme peut, à la demande de celle-ci, être associé à la concertation. Hors urgence médicale, la femme se voit proposer un délai de réflexion d’au moins une semaine avant de décider d’interrompre ou de poursuivre sa grossesse.
Dans les deux cas, préalablement à la réunion de l’équipe pluridisciplinaire compétente, la femme concernée ou le couple peut, à sa demande, être entendu par tout ou partie des membres de ladite équipe.
Article L2213-2
Les dispositions des articles L. 2212-2 et L. 2212-8 à L. 2212-10 sont applicables à l’interruption volontaire de la grossesse pratiquée pour motif médical.
Article L2213-3
Les conditions d’application du présent chapitre sont déterminées par décret en Conseil d’Etat.
Chapitre IV: Dispositions communes.
Article L2214-1
Les frais occasionnés par le contrôle de l’application des dispositions des chapitres II et III du présent titre sont supportés par l’Etat.
Article L2214-2
En aucun cas l’interruption volontaire de grossesse ne doit constituer un moyen de régulation des naissances. A cet effet, le Gouvernement prend toutes les mesures nécessaires pour développer l’information la plus large possible sur la régulation des naissances, notamment par la création généralisée, dans les centres de planification maternelle et infantile, de centres de planification ou d’éducation familiale et par l’utilisation de tous les moyens d’information.
La formation initiale et la formation permanente des médecins, des sages-femmes, ainsi que des infirmiers et des infirmières, comprennent un enseignement sur la contraception.
Article L2214-3
Chaque année, à l’occasion de la discussion du projet de loi de finances, le ministre chargé de la santé publie un rapport rendant compte de l’évolution démographique du pays, ainsi que de l’application des dispositions du présent titre.
Ce rapport comporte des développements sur les aspects socio-démographiques de l’interruption de grossesse.
L’Institut national d’études démographiques analyse et publie, en liaison avec l’Institut national de la santé et de la recherche médicale, les statistiques établies à partir des déclarations prévues à l’article L. 2212-10.

Titre II: Dispositions pénales
Chapitre II: Interruption illégale de grossesse.
Article L2222-1
Comme il est dit à l’article 223-10 du code pénal ci-après reproduit:
“L’interruption de la grossesse sans le consentement de l’intéressée est punie de cinq ans d’emprisonnement et de 75 000 euros d’amende.”
Article L2222-2
L’interruption de la grossesse d’autrui est punie de deux ans d’emprisonnement et de 30000 euros d’amende lorsqu’elle est pratiquée, en connaissance de cause, dans l’une des circonstances suivantes :
1° Après l’expiration du délai dans lequel elle est autorisée par la loi, sauf si elle est pratiquée pour un motif médical ;
2° Par une personne n’ayant pas la qualité de médecin ;
3° Dans un lieu autre qu’un établissement d’hospitalisation public ou qu’un établissement d’hospitalisation privé satisfaisant aux conditions prévues par la loi, ou en dehors du cadre d’une convention conclue selon les modalités prévues à l’article L. 2212-2.
Cette infraction est punie de cinq ans d’emprisonnement et de 75000 euros d’amende si le coupable la pratique habituellement.
La tentative des délits prévus au présent article est punie des mêmes peines.
Article L2222-3
Le fait de procéder à une interruption de grossesse après diagnostic prénatal sans avoir respecté les modalités prévues par la loi est puni de deux ans d’emprisonnement et de 30000 euros d’amende.
Article L2222-4
Le fait de fournir à la femme les moyens matériels de pratiquer une interruption de grossesse sur elle-même est puni de trois ans d’emprisonnement et de 45000 euros d’amende. Ces peines sont portées à cinq ans d’emprisonnement et à 75000 euros d’amende si l’infraction est commise de manière habituelle. En aucun cas, la femme ne peut être considérée comme complice de cet acte.
La prescription ou la délivrance de médicaments autorisés ayant pour but de provoquer une interruption volontaire de grossesse ne peut être assimilée au délit susmentionné.
Chapitre III: Entrave à l’interruption légale de grossesse.
Article L2223-1
Toute association régulièrement déclarée depuis au moins cinq ans à la date des faits, dont l’objet statutaire comporte la défense des droits des femmes à accéder à la contraception et à l’interruption de grossesse, peut exercer les droits reconnus à la partie civile en ce qui concerne les infractions prévues par l’article L. 2223-2 lorsque les faits ont été commis en vue d’empêcher ou de tenter d’empêcher une interruption volontaire de grossesse ou les actes préalables prévus par les articles L. 2212-3 à L. 2212-8.
Article L2223-2
Est puni de deux ans d’emprisonnement et de 30000 euros d’amende le fait d’empêcher ou de tenter d’empêcher une interruption de grossesse ou les actes préalables prévus par les articles L. 2212-3 à L. 2212-8 :
– soit en perturbant de quelque manière que ce soit l’accès aux établissements mentionnés à l’article L. 2212-2, la libre circulation des personnes à l’intérieur de ces établissements ou les conditions de travail des personnels médicaux et non médicaux;
– soit en exerçant des pressions morales et psychologiques, des menaces ou tout acte d’intimidation à l’encontre des personnels médicaux et non médicaux travaillant dans ces établissements, des femmes venues y subir une interruption volontaire de grossesse ou de l’entourage de ces dernières.

Livre II : Interruption volontaire de grossesse
Titre Ier : Dispositions générales
Chapitre II : Interruption pratiquée avant la fin de la douzième semaine de grossesse
Section 1 : Consultation précédant l’interruption volontaire de grossesse.
Article R2212-1
La consultation mentionnée à l’article L. 2212-4 est donnée :
1° Soit dans un établissement d’information, de consultation ou de conseil familial, créé en application de l’article L. 2311-1 ;
2° Soit dans un centre de planification ou d’éducation familiale agréé en application de l’article L. 2311-2 ;
3° Abrogé ;
4° Soit dans un organisme agréé dans les conditions fixées aux articles R. 2212-2 et R. 2212-3.
Article R2212-2
Pour bénéficier d’un agrément pour l’application de l’article L. 2212-4, les organismes mentionnés au 4° de l’article R. 2212-1 doivent satisfaire aux conditions suivantes :
1° Etre gérés par une personne morale de droit public ou par une personne morale de droit privé à but non lucratif et à vocation sociale ;
2° Disposer de locaux appropriés à la nature de l’entretien prévu à l’article L2212-4 ;
3° Disposer d’un personnel assurant les consultations présentant les aptitudes et l’expérience nécessaires et n’ayant pas été condamné pour des faits contraires à l’honneur, à la probité et aux bonnes moeurs, ou pour une infraction prévue aux articles 226-13 et 226-14 du code pénal, au titre II du présent livre et au chapitre IV du titre III du livre IV de la partie V du présent code;
4° S’engager à assurer une périodicité au moins hebdomadaire des consultations.
Article R2212-3
L’agrément est accordé par le préfet du département, après consultation d’une commission dont la composition est fixée par arrêté du ministre chargé de la santé.
Cette commission comprend notamment des fonctionnaires des services relevant du ministre chargé de l’action sociale, un médecin de l’agence régionale de santé, des représentants des associations familiales et des personnes qualifiées en matière familiale et sociale.
L’agrément peut être donné à titre provisoire ou pour une durée limitée.
Il est retiré selon la même procédure, après que l’organisme a été invité à présenter ses observations, lorsque cet organisme méconnaît les prescriptions du deuxième alinéa de l’article L. 2212-4, ou cesse de satisfaire aux conditions posées à l’article R. 2212-2.
Section 2 : Pratique des interruptions volontaires de grossesse dans les établissements de santé.
Article R2212-4
Les établissements publics définis aux articles L. 6132-1, L. 6132-2, L. 6141-1 L. 6141-2 et L. 6147-3 qui disposent de lits ou de places autorisés en gynécologie-obstétrique ou en chirurgie ne peuvent refuser de pratiquer des interruptions volontaires de grossesse.
Article R2212-5
Pour pratiquer des interruptions volontaires de grossesse, les établissements privés doivent disposer de lits ou de places autorisés en gynécologie-obstétrique ou en chirurgie.
Article R2212-6
Les établissements publics ou privés qui pratiquent les interruptions volontaires de grossesse disposent de capacités leur permettant de prendre en charge, sans délai, au sein de leurs installations de médecine, de gynécologie-obstétrique ou de chirurgie, toute complication, même différée, survenant aux femmes ayant eu recours à une interruption volontaire de grossesse.
Article R2212-7
Les établissements publics qui pratiquent des interruptions volontaires de grossesse comportent un centre de planification ou d’éducation familiale agréé ou passent une convention afin que ce centre exerce, dans l’établissement, les activités définies par les articles R. 2311-7 à R. 2311-18.
Les établissements privés qui pratiquent des interruptions volontaires de grossesse passent une convention avec un centre de planification ou d’éducation familiale agréé afin que ce centre exerce les activités définies par les articles R. 2311-7 à R. 2311-18.
Section 3 : Conditions de réalisation des interruptions volontaires de grossesse hors établissements de santé.
Article R2212-9
La convention prévue à l’article L. 2212-2 est conforme à la convention type constituant l’annexe 22-1.
Article R2212-10
Les interruptions volontaires de grossesse pratiquées par un médecin dans le cadre de la convention mentionnée à l’article R. 2212-9 sont exclusivement réalisées par voie médicamenteuse et jusqu’à la fin de la cinquième semaine de grossesse. Le médecin assure le suivi de la femme, conformément aux recommandations professionnelles validées par la Haute Autorité de santé.
Article R2212-11
Le médecin effectuant des interruptions volontaires de grossesse par voie médicamenteuse dans le cadre de la convention mentionnée à l’article R. 2212-9 justifie d’une expérience professionnelle adaptée, soit par une qualification universitaire en gynécologie médicale ou en gynécologie-obstétrique, soit par une pratique régulière des interruptions volontaires de grossesse médicamenteuses dans un établissement de santé, attestée par le directeur de cet établissement sur justificatif présenté par le responsable médical concerné.
Article R2212-12
Avant de recueillir le consentement écrit de la femme dont l’âge de la grossesse et dont l’état médical et psycho-social permet la réalisation d’une interruption volontaire de grossesse par mode médicamenteux, le médecin l’informe sur les différentes méthodes d’interruption volontaire de grossesse et sur leurs éventuelles complications.
Le médecin rappelle à la femme la possibilité de rencontrer une personne ayant satisfait à une formation qualifiante en conseil conjugal ou toute autre personne qualifiée dans un établissement ou organisme agréé dans les conditions prévues à l’article L. 2212-4.
Le médecin délivre à la femme une information complète sur la contraception et les maladies sexuellement transmissibles.
Article R2212-13
Le médecin précise par écrit à la femme le protocole à respecter pour la réalisation de l’interruption volontaire de grossesse par mode médicamenteux.
Il invite la femme à se faire accompagner par la personne de son choix, notamment à l’occasion des consultations au cours desquelles sont administrés les médicaments.
Article R2212-14
Le médecin informe la femme sur les mesures à prendre en cas de survenance d’effets secondaires. Il s’assure que la femme dispose d’un traitement analgésique et qu’elle peut se rendre dans l’établissement de santé signataire de la convention dans un délai de l’ordre d’une heure.
Article R2212-15
Le médecin remet à la femme un document écrit dans lequel sont indiqués l’adresse précise et le numéro de téléphone du service concerné de l’établissement de santé signataire de la convention. Il lui indique la possibilité d’être accueillie à tout moment par cet établissement.
Il remet également à la femme une fiche de liaison, définie conjointement avec l’établissement de santé signataire de la convention, contenant les éléments utiles de son dossier médical. Ce document est remis par la femme au médecin de l’établissement de santé, lors de son admission.
Article R2212-16
Seuls les médecins, les centres de planification ou d’éducation familiale et les centres de santé ayant conclu la convention mentionnée à l’article R. 2212-9 peuvent s’approvisionner en médicaments nécessaires à la réalisation d’une interruption volontaire de grossesse par voie médicamenteuse.
Pour s’approvisionner en médicaments nécessaires à la réalisation de cette interruption volontaire de grossesse, le médecin passe commande à usage professionnel auprès d’une pharmacie d’officine. Cette commande, rédigée dans les conditions prévues à l’article R. 5194, indique en outre le nom de l’établissement de santé, public ou privé, avec lequel il a conclu la convention mentionnée à l’article R. 2212-9 et la date de cette convention.
Article R2212-17
La prise des médicaments nécessaires à la réalisation de l’interruption volontaire de grossesse est effectuée en présence du médecin.
Article R2212-18
Une consultation de contrôle et de vérification de l’interruption de la grossesse est réalisée au minimum dans les quatorze jours et au maximum dans les vingt et un jours suivant l’interruption volontaire de grossesse.
Article R2212-19
Pour l’application dans la collectivité territoriale de Saint-Pierre-et-Miquelon des dispositions des articles R. 2212-9 à R. 2212-18, aux mots : ” Etablissement de santé ” et ” établissement de santé satisfaisant aux dispositions de l’article L. 2322-1 ” sont substitués les mots : ” l’Etablissement public de santé territorial de Saint-Pierre-et-Miquelon “.
Chapitre III: Interruption de grossesse pratiquée pour motif médical
Section unique
Article R2213-1
Lorsqu’une femme enceinte envisage de recourir à une interruption de grossesse au motif que la poursuite de sa grossesse met en péril grave sa santé, elle en fait la demande auprès d’un médecin spécialiste qualifié en gynécologie-obstétrique exerçant son activité dans un établissement public de santé ou dans un établissement de santé privé satisfaisant aux conditions de l’article L. 2322-1.
Article R2213-2
Le médecin spécialiste qualifié en gynécologie/obstétrique saisi de la demande mentionnée ci-dessus constitue et réunit, pour avis consultatif, l’équipe pluridisciplinaire prévue au deuxième alinéa de l’article L. 2213-1.
Article R2213-3
L’équipe pluridisciplinaire prévue au deuxième alinéa de l’article L. 2213-1 comprend :
1° Un médecin qualifié en gynécologie-obstétrique ;
2° Un médecin choisi par la femme ;
3° Un assistant social ou un psychologue ;
4° Un ou des praticiens qualifiés pour donner un avis sur l’état de santé de la femme.
Un procès-verbal de la réunion de cette équipe est établi.
Article R2213-4
La femme concernée ou le couple est entendu, à sa demande, par tout ou partie des membres de l’équipe pluridisciplinaire préalablement à la concertation mentionnée à l’article R. 2213-5.
Article R2213-5
Si, au terme de la concertation menée par l’équipe pluridisciplinaire, il apparaît à deux médecins que la poursuite de la grossesse met en péril grave la santé de la femme, ceux-ci établissent les attestations prévues au premier alinéa de l’article L. 2213-1.
Article R2213-6
L’établissement de santé mentionné à l’article R. 2213-1 conserve pour chaque demande d’avis les éléments du dossier médical transmis par le médecin traitant, les attestations mentionnées à l’article R. 2213-5 ainsi que le procès-verbal de la réunion de l’équipe pluridisciplinaire et, le cas échéant, les résultats des examens médicaux pratiqués. Article R2222-1
Le fait pour un directeur d’établissement de santé où une femme est admise en vue d’une interruption volontaire de grossesse de ne pas se faire remettre ou de ne pas conserver pendant un an les attestations justifiant que l’intéressée a satisfait aux consultations prescrites aux articles L. 2212-3 à L. 2212-5, est puni de l’amende prévue pour les contraventions de la cinquième classe.
Est puni de la même peine le fait pour le directeur d’un établissement de santé de ne pas se faire remettre ou de ne pas conserver pendant trois ans l’attestation médicale prévue par l’article L. 2213-1.
Article R2222-2
Le fait pour un médecin de ne pas établir la déclaration prévue par l’article L. 2212-10 est puni de l’amende prévue pour les contraventions de cinquième classe.
Est puni de la même peine le fait pour le directeur d’un établissement de santé de ne pas adresser cette déclaration au médecin de l’agence régionale de santé désigné par le directeur général de l’agence dans les conditions prévues à l’article L. 2212-10.
Article R2222-3
La récidive des contraventions prévues aux articles R. 2222-1 et R. 2222-2 est réprimée conformément à l’article 132-11 du code pénal.

Book II: Voluntary termination of pregnancy
Title 1: General provisions
Chapter I: General principles
Article L2211-1
As stated in article 16 of the Civil Code, reproduced below:
“The law ensures the primacy of the person, prohibits any infringement of the dignity of this, and guarantees respect for the human being from the beginning of its life.”
Article L2211-2
There can be no infringement of the principle referred to in article L. 2211-1 except in case of necessity and in accordance with the conditions defined in this title.
Teaching on this principle and its consequences, on information on life issues and national and international demographics, on education about responsibility, on the reception of the child in society, and on family policy are national obligations. The State, with the assistance of territorial authorities, shall execute these obligations and shall support initiatives that contribute to them.
Chapter II: Termination performed before the end of the twelfth week of pregnancy.
Article L2212-1
Every woman who does not want to follow through with a pregnancy can obtain an abortion, her decision not being tied to any particular difficulty. This termination may only be performed before the end of the twelfth week of pregnancy.
Article L2212-2
Voluntary termination of pregnancy may only be performed by a physician.
It may only take place in a health facility, public or private, or within the framework of an agreement concluded between the practitioner or a center for family education or planning or a health center and such a facility under conditions determined by a decree of the State Council.
Article L2212-3
The physician requested by a woman to terminate her pregnancy must, at the first visit, inform her about the medical and surgical methods for the termination of pregnancy and the risks and potential side effects.
He must provide her with a file-guide updated at least one time a year, including in particular a reminder of the provisions of Articles L. 2212-1 and L. 2212-2 and a list of addresses and organizations referred to in Article L. 2212-4 and of facilities where voluntary interruptions of pregnancy are performed.
Regional health agencies shall ensure the production and dissemination of file-guides intended for physicians.
Article L2212-4
Before and after a voluntary termination of pregnancy an adult woman shall be routinely offered a consultation with a person who has satisfied qualified training as a marriage counselor or any other qualified person in a facility for information, consultation, or family counseling, a center for planning or family education, a social service, or another approved organization. This preliminary consultation shall include a particular discussion during which assistance or counseling appropriate to the situation of the concerned person shall be provided.
This preliminary consultation is mandatory for a non-emancipated minor and the concerned organization must provide her with a certificate of counseling. If she expresses the desire to maintain confidentiality with respect to the holders of parental authority or her legal representative, she must be counseled on the choice of an adult referred to in Article L. 2212-7 likely to accompany her in her step.
The staff of organizations referred to in the first paragraph are subject to the provisions of articles 226-13 and 226-14 of the penal code.
Whenever possible a couple shall participate in the consultation and the decision to take.
Article L2212-5
If, after the consultations provided for in articles L. 2212-3 and L. 2212-4, the woman renews her request for a termination of pregnancy, the physician must request a written confirmation from her, he may only accept this confirmation after the expiration of a week following the first request of the woman, except when the term of twelve weeks risks being passed. This confirmation can only occur after the expiration of a delay of two days following the discussion provided for in article L. 2212-4, this delay may be included in that of the week provided for above.
Article L2212-6
In the case of confirmation, the physician may perform the termination of pregnancy himself in the conditions set in the second paragraph of article L. 2212-2. If he does not perform the procedure himself, he shall return the request to the woman so that it can be submitted to a physician of her choice and shall issue her a certificate stating that she has complied with the provisions of articles L. 2212-3 and L. 2212-5.
The director of the health facility at which a woman requests her admission for a voluntary termination of pregnancy must collect and keep the certificates substantiating that she has undergone the consultations prescribed in articles L. 2212-3 to L. 2212-5.
Article L2212-7
If the woman is a non-emancipated minor, the consent of one of the holders of parental authority or, where applicable, of her legal representative shall be collected. This consent shall be attached to the request that she presents to the physician outside the presence of any other person.
If the non-emancipated minor desires to maintain confidentiality, the physician must strive, in her interest, to obtain her consent that one or both of the holders of parental authority or, where applicable, of the legal representative be consulted or must verify that this step has been taken during the discussion referred to in article L. 2212-4.
If the minor desires not to take this step or if consent is not obtained, the voluntary termination of pregnancy as well as the medical procedures and care that are related to it may be performed at the request of the interested person, set out in the conditions provided for in the first paragraph. In this case the minor shall be accompanied in her step by an adult of her choice.
After the procedure, a second consultation shall be mandatorily proposed to minors, aimed in particular at new information on contraception.
Article L2212-8
A physician is never required to perform a voluntary termination of pregnancy, but he must without delay inform the interested person of his refusal and must immediately communicate to her the names of practitioners likely to carry out this procedure according to the procedures provided for in article L. 2212-2.
No midwife, no nurse, no medical auxiliary, of whatever kind, is required to assist in the interruption of a pregnancy.
A private health facility may refuse to have voluntary terminations of pregnancy performed on its premises.
However, this refusal may not be invoked by a facility referred to in paragraph 2 of article L. 6161-5 or by a facility having concluded an agreement of concession pursuant to article L. 6161-9 in its version prior to Law No. 2009-879 of 21 July 2009 on hospital reform and on patients, health, and territories unless other facilities are able to respond to local needs.
The categories of public facilities required to have at their disposal means allowing them to perform voluntary terminations of pregnancy are set by a decree.
Article L2212-9
Any facility in which a termination of pregnancy is performed must, after the procedure, ensure information to the woman on birth control.
Article L2212-10
Any termination of pregnancy must be the subject of a statement prepared by the physician and addressed by the facility where it is performed to the physician of the regional health agency designated by the Director General of the agency, this statement shall make no mention of the identity of the woman.
Article L2212-11
Conditions for the application of this chapter shall be determined by a decree of the State Council.

Chapter III: Termination of pregnancy performed for medical reason.
Article L2213-1
Voluntary termination of pregnancy may be performed at any time if two physicians, members of a multidisciplinary team, certify, after the team has issued its advisory opinion, that continuance of the pregnancy seriously endangers the health of the woman or that there exists a strong probability that the unborn child is suffering from a disorder of particular seriousness recognized as incurable at the moment of diagnosis.
When the termination of pregnancy is considered for the reason that continuance of the pregnancy seriously endangers the health of the woman, the multidisciplinary team with responsibility for examining the request of the woman shall consist of at least four persons, these are a physician qualified in gynecology/obstetrics who is a member of a multidisciplinary center for prenatal diagnosis, a practitioner who is a specialist in the disorder from which the woman is suffering, a physician chosen by the woman, and a qualified person bound by professional confidentiality who may be a social worker or a psychologist. The physician qualified in gynecology/obstetrics and the physician who is a specialist in the disorder from which the woman is suffering must exercise their activities in a health facility.
When the termination of pregnancy is considered for the reason that there exists a strong probability that the unborn child is suffering from a disorder of particular seriousness recognized as incurable at the moment of diagnosis, the multidisciplinary team with responsibility for examining the request of the woman is that of a multidisciplinary center for prenatal diagnosis. When the team of the center above meets, a physician chosen by the woman may, at her request, be involved in the dialogue. Apart from medical urgency, a delay for reflection of at least one week before deciding to interrupt or continue the pregnancy shall be suggested to the woman.
In both cases, prior to the meeting of the competent multidisciplinary team, the woman concerned or the couple may, at their request, be heard by all or part of the members of this team.
Article L2213-2
The provisions of articles L. 2212-2 and L. 2212-8 to L. 2212-10 shall be applicable to the voluntary termination of pregnancy performed for a medical reason.
Article L2213-3
The conditions for application of this chapter shall be determined by a decree of the Council of State.
Chapter IV: Common provisions.
Article L2214-1
The costs incurred in managing the application of the provisions of chapters II and III of this title shall be borne by the State.
Article L2214-2
In no case should voluntary termination of pregnancy constitute a means of birth control. To this end, the Government shall adopt all necessary measures to elaborate the most comprehensive information possible on birth control, particularly by widespread establishment in maternal and infant planning centers and planning or family education centers and by the utilization of all informational means.
Initial and continuing training of physicians, midwives, as well as nurses, shall include teaching on contraception.
Article L2214-3
Each year on the occasion of the discussion of the draft law on finances, the minister responsible for public health shall publish a report taking account of the demographic changes of the country, as well as of the application of the provisions of this Title.
This report shall include developments on the socio-demographic aspects of the termination of pregnancy.
The National Institute of Demographic Studies, in conjunction with the National Institute of Health and Research, shall analyze and publish statistics established on the basis of the statements provided for in article L. 2212-10.

Title II: Penal provisions
Chapter II: Illegal termination of pregnancy
Article L2222-1
As stated in article 223-10 of the Penal Code, reproduced below:
“Termination of pregnancy without the consent of the concerned person shall be punished with 5 years’ imprisonment and a fine of 75,000 euros.”
Article L2222-2
The termination of pregnancy of another person shall be punished with two years’ imprisonment and a fine of 30,000 euros when it is performed, knowingly, in one of the following circumstances:
1. After the expiration of the delay in which it is authorized by law, unless it is performed for a medical reason,
2. By a person not qualified as a physician,
3. In a place other than a public facility for hospitalization or a private facility for hospitalization satisfying the conditions provided for by law, or outside of the framework of an agreement concluded in the manner provided for in article L. 2212-2.This offense shall be punished with five years’ imprisonment and a fine of 75,000 euros if the guilty person regularly performs it. Attempted offenses provided for in this article shall be punished with the same penalties.
Article L2222-3
Proceeding with a termination of pregnancy after a prenatal diagnosis without having complied with the procedures provided for by the law shall be punished with two years’ imprisonment and a fine of 30,000 euros.
Article L2222-4
Furnishing a woman with the material means for performing a termination of pregnancy on herself shall be punished with three months’ imprisonment and a fine of 45,000 euros. The penalties shall be increased to five years’ imprisonment and a fine of 75,000 euros if the offense is committed in a regular manner. In no case may the woman be considered an accomplice to this act.
The prescription or supply of medicaments authorized for the purpose of provoking a voluntary termination of pregnancy may not be equated with the offense referred to above.
Chapter III: Obstructing the legal termination of pregnancy.
Article L2223-1
Any association regularly registered for at least five years from the date of the acts, whose statutory purpose includes the defense of the rights of women to have access to contraception and the termination of pregnancy, may exercise the rights recognized for a civil party with respect to the offenses provided for by article L. 2223-2 when the acts have been committed for the purpose of preventing or attempting to prevent the voluntary termination of pregnancy or preliminary acts provided for in articles L. 2212-3 to L. 2212-8.
Article L2223-2
Preventing or attempting to prevent a termination of pregnancy or preliminary acts provided for in articles L. 2212-3 to L. 2212-8 shall be punished with two years’ imprisonment and a fine of 30,000 euros.
– whether by disrupting in any manner whatever access to facilities referred to in article L. 2212-2, the free movement of persons within these facilities, or the working conditions of medical and non-medical staff,
– or by employing moral or psychological pressure, threats, or any act of intimidation with respect to medical and non-medical staff working in these facilities, woman who have come there to undergo a termination of pregnancy, or those accompanying them.

Title I: General provisions
Chapter II: Termination performed before the end of the twelfth week of pregnancy
Section 1: Consultation preceding the voluntary termination of pregnancy
Article R2212-1
The consultation referred to in article L. 2214-4 shall be given:
1. Either in a facility of information, consultation, or family counseling created in application of article L. 2311-1,
2. Or in a center of planning or family education approved in application of article L. 2311-2,
3. Repealed,
4. Or in an organization approved under the conditions set in articles R. 2212-2 and R. 2212-3.
Article R2212-2
To obtain approval in application of article L. 2212-4, the organizations referred to in no. 4 of article R. 2212-1 must meet the following conditions:
1. Be managed by a legal person under public law or a legal person under private law that is non-profit and has a social purpose,
2. Have premises appropriate for the kind of discussion provided for in article L. 2212-4,
3. Have a staff ensuring consultations with the necessary skills and experience and who have not been convicted for acts contrary to honor, probity, and good morals or for an offense provided for in articles 226-13 and 226-14 of the penal code, in title II of this book, and in chapter IV of title III of book IV of part V of this code,
4. Be committed to ensure a frequency of weekly consultations at least.
Article R2212-3
The approval shall be granted by the prefect of the department, after consultation with a commission whose composition is set by an order of the minister with responsibility for health.
This commission includes in particular officials of services under the minister responsible for social action, a physician of the regional health agency, representatives of family associations, and persons qualified in family and social matters.
Approval may be granted on a provisional basis or for limited duration.
It shall be withdrawn according to the same procedure, after the organization has been invited to submit its observations, when this organization disregards the requirements of the second paragraph of article L. 2214-4 or stops meeting the conditions set by article R. 2212-2.
Section 2: Performance of voluntary terminations of pregnancy in health facilities.
Article R2212-4
Public facilities defined in articles L. 6132-1, L. 6132-2, L. 6141-1, L. 6141-2, and L. 6147-3 that have beds or places authorized for gynecology/obstetrics or surgery may not refuse to perform voluntary terminations of pregnancy.
Article R2212-5
In order to perform voluntary terminations of pregnancy, private facilities must have beds or places authorized for gynecology/obstetrics or surgery.
Article R2212-6
Public or private facilities that perform voluntary terminations of pregnancy shall have the capacity to allow them to manage, without delay, within their medical, gynecological/obstetrical, or surgical facilities, any complication, even delayed, arising for women who have had recourse to voluntary termination of pregnancy.
Article R2212-7
Public facilities that perform voluntary terminations of pregnancy shall include a center for family planning or education approved or having entered into an agreement for this center exercise, within the center, activities defined by articles R. 2311-7 to R. 2311-18.
Private facilities that perform voluntary terminations of pregnancy having entered into an agreement with a family planning or education center approved for this center to exercise the activities defined in articles R. 2311-7 to R. 2311-8.
Section 3: Conditions for carrying out voluntary terminations of pregnancy outside health facilities.
Article R2212-9
The agreement provided for in article L. 2212-2 shall be in conformity with the model agreement constituting annex 22-1.
Article R2212-10
Voluntary terminations of pregnancy performed by a physician within the framework of an agreement referred to in article R. 2212-9 shall be exclusively carried out by means of medication and until the end of the fifth week of pregnancy. The physician shall ensure monitoring of the woman in accordance with professional recommendations validated by the High Authority of Health.
Article R2212-11
The physician carrying out voluntary terminations of pregnancy by means of medication within the framework of the agreement referred to in article R. 2212-9 shall substantiate appropriate professional experience either by university qualification in medical gynecology or gynecology/obstetrics or by the regular performance of voluntary terminations of pregnancy by medication in a health facility certified by the director of this facility on evidence presented by the concerned responsible medical person.
Article R2212-12
Before collecting the written consent of a woman whose length of pregnancy and whose medical and psycho-social state allow the performance of a voluntary termination of pregnancy by means of medication, the physician shall inform her on the various methods for voluntary termination of pregnancy and on their possible complications.
The physician shall remind the woman of the opportunity of meeting with a person who has satisfied qualified training in marital counseling or any other qualified person in a facility or organization approved under the conditions provided for in article L. 2212-4.
The physician shall provide the woman with complete information on contraception and sexually transmitted diseases.
Article R2212-13
The physician shall specify to the woman in writing the protocol to be followed for the realization of voluntary terminations of pregnancy by means of medication.
He shall invite the woman to be accompanied by the person of her choice, particularly on the occasion of consultations in the course of which the medications are administered.
Article R2212-14
The physician shall inform the woman about measures to take in the case of occurrence of side effects. He shall ensure that the woman has an analgesic and that she is able to go to a health facility that has signed an agreement within about an hour.
Article R2212-15
The physician shall give the woman a written document in which the exact address and telephone number of the concerned service of the health facility that has signed the agreement are indicated. He shall indicate the possibility of being received by this facility.
He shall also give the woman a file of association, defined jointly with the facility that has signed the agreement, containing useful facts from her medical records. This document shall be given by the woman to the physician of the health facility upon her admission.
Article R2212-16
Only physicians, family planning or education centers, and health centers that have entered into an agreement referred to in article R. 2212-9 may obtain supplies of medications needed to carry out a voluntary termination of pregnancy by means of medication.
In order to obtain supplies of medications necessary to carry out this voluntary termination of pregnancy, the physician shall order for professional use from a pharmacy. This order, written under the conditions provided for in article R. 5194 shall, in addition, indicate the name of the public or private health facility with which he has entered into the agreement referred to in article R. 2212-9 and the date of the agreement.
Article R2212-17
The acceptance of medications necessary to carry out a voluntary termination of pregnancy shall be carried out in the presence of a physician.
Article R2212-18
A consultation for monitoring and verification of the termination of pregnancy shall be carried out at a minimum of fourteen days and a maximum of twenty-one days after the voluntary termination of pregnancy.
Article R2212-19
In application of the provisions of articles R. 2212-9 to R. 2212-18 in the territorial community of Saint-Pierre-and-Miquelon the words “health facility” and “health facility satisfying the provisions of article L. 2322-1” shall be substituted with the words “territorial public health facility of Saint-Pierre-and-Miquelon”.
Chapter III: Termination of pregnancy performed for medical reason

Article R2213-1
When a pregnant woman considers recourse to a termination of pregnancy because her pregnancy seriously endangers her health, she shall make the request for it to a specialist physician qualified in gynecology/obstetrics exercising his activity in a public health facility or in a private health facility satisfying the conditions of article L. 2322-1.
Article R2213-2
The specialist physician qualified in gynecology/obstetrics presented with the request referred to above shall establish and convene for an advisory opinion a multidisciplinary team provided for in the second paragraph of article L. 2213-1.
Article R2213-3
The multidisciplinary team provided for in the second paragraph of article L. 2213-1 shall consist of:
1. A physician qualified in gynecology/obstetrics,
2. A physician chosen by the woman,
3. A social worker or a psychologist,
4. One or more practitioners qualified to give an opinion on the woman’s state of health.
Minutes of the meeting of this team shall be drawn up.
Article R2213-4
The woman concerned or the couple shall be heard, at their request, by all or part of the members of the multidisciplinary team prior to the consultation referred to in article R. 2213-5.
Article R2213-5
If, at the end of the consultation carried out by the multidisciplinary team, it appears to two physicians that the continuance of the pregnancy seriously endangers the health of the woman, these shall draw up the certificates provided for in the first paragraph of article L. 2213-1.
Article R2213-6
The health facility referred to in article R. 2213-1 shall keep for each request for an opinion the facts of medical records forwarded by the treating physician, the certificates referred to in article R2213-5, as well as the minutes of the meeting of the multidisciplinary team, and, where applicable, the results of medical examinations performed. The documents referred to in this article shall be kept under conditions guaranteeing their confidentiality.

Article R2222-1
If the director of a health facility where a woman is admitted for a voluntary termination of pregnancy does not have the certificates proving that the interested person has gone through the consultations prescribed in articles L. 2212-3 to L. 2212-5 given to him or does not keep them for a year he shall be punished with a fine provided for offenses of the fifth class.
If the director of a health facility does not have the medical certificate provided for in article L. 2213-1 given to him or does not preserve them for three years he shall be punished with same penalty.
Article R2222-2
If a physician does not prepare a statement provided for in article L. 2212-10 he shall be punished with a fine provided for offenses of the fifth class.
If the director of a health facility does not address this statement to the physician of the regional health agency designated by the director general of the agency in the conditions provided for in article L2212-10, he shall be punished with the same penalty.
Article R2222-3
Recurrence of the offenses provided for in articles R. 2222-1 and R. 2222-2 shall be punished in accordance with article 132-11 of the penal code.
