State Constitutions and Abortion Rights: Building Protections for Reproductive Autonomy (Report, July 2022)
This Center report provides detailed analysis of state high court cases litigated by the Center that built strong protections for abortion rights and access using personal autonomy, privacy, and equality frameworks prior to the Dobbs decision.
It focuses on key decisions in Alaska, Arizona, Florida, Kansas, Minnesota, Montana, and New Mexico that protected abortion more strongly than the U.S. Supreme Court even prior to Dobbs. The analysis considers how this jurisprudence can expand and shape ongoing efforts to secure reproductive rights.
