Amici address the meaning and scope of the Texas constitution’s affirmative right to life, demonstrating that it has always included more than a right of mere survival and encompasses a pregnant person’s right to protect their health, safety, and wellbeing. The brief also argues that the Texas Supreme Court should follow the approach of sister state courts, which have held that their constitutions protect a right to an abortion to preserve life and health.
