The brief argues that the right to abortion is well grounded in the Constitution under the Fourteenth Amendment’s Due Process Clause and rejecting a Due Process right to abortion would upend other Due Process rights.

Amici argue that stare decisis requires the Court to uphold precedent establishing the right to pre-viability abortion, which is non-arbitrary, workable, and constitutionally principled.
