Resolución de supervisión de cumplimiento en el caso de Paola Guzmán Albarracín

La Corte IDH notificó el pasado 19 de octubre de 2021 una resolución de supervisión de cumplimiento en el caso de Paola Guzmán Albarracín. El tribunal señaló que aún están pendientes de cumplimiento las medidas de no repetición.

Ecuador tiene pendiente implementar las medidas de no repetición ordenadas por la Corte IDH en el caso de Paola Guzmán Albarracín

Octubre 25 de 2021 – La Corte Interamericana de Derechos Humanos (Corte IDH) notificó el pasado 19 de octubre de 2021 una resolución de supervisión de cumplimiento en el caso de Paola Guzmán Albarracín. El tribunal señaló que, si bien Ecuador ha cumplido hasta el momento con la mayoría de las medidas de reparación de carácter individual a favor de las víctimas, aún están pendientes de cumplimiento las medidas de no repetición para que así niñas, niños y adolescentes puedan estar libres de acoso y abuso sexual en el ámbito educativo.

En su sentencia de 2020, la Corte declaró responsable a Ecuador porque no le garantizó a Paola los derechos a la vida, integridad personal, a la protección de la honra y de la dignidad, educación, y a vivir libre de violencia de género y discriminación. Paola fue una niña acosada y abusada sexualmente por el vicerrector del plantel al que asistía, la Corte IDH dio por probado que ella vivió una situación continuada de abuso y violencia que le generó un grave sufrimiento, lo que le llevó a intentar suicidarse. También consideró que se habían violado los derechos a las garantías judiciales y protección judicial en perjuicio de su familia. Así, por primera vez en este tribunal se dejó claro que el derecho a la educación debe contemplar la educación sexual y reproductiva.

El Centro de Derechos Reproductivos y CEPAM-Guayaquil, las organizaciones representantes de las víctimas del caso, reconocemos los avances que se han dado desde la emisión de la sentencia hasta el presente en el cumplimiento de las medidas de reparación individuales. Reconocemos, como ya lo hicimos en el pasado Día oficial de lucha contra la violencia sexual en las aulas, que el Estado ha tenido buena disposición para dar cumplimiento a la sentencia y hay varios puntos que ya se han ejecutado a satisfacción, como lo señala la misma Corte en su resolución.

Sin embargo, recordamos que el cumplimiento total de la sentencia del caso Paola es fundamental para que millones de niñas, niños y adolescentes en Ecuador puedan tener garantías plenas de sus derechos. Para tal fin es necesario que se adopten medidas para que se garantice acceso a niñas, niños y adolescentes educación sexual integral, con el fin de brindarles herramientas para identificar, defenderse y denunciar actos de violencia sexual.

Por eso, es preciso que el Estado ecuatoriano que permita a las representantes de las víctimas y a demás organizaciones de la sociedad civil participar de manera activa en el diseño e implementación de las medidas para garantizar que no siga existiendo un contexto que permita la violencia sexual en las aulas. Las organizaciones defensoras de derechos humanos estamos listas para poner a disposición del Estado nuestra experiencia y conocimiento en el ámbito de los derechos sexuales y reproductivos para respaldar el diseño de políticas estructurales que aseguren el cumplimiento de la no repetición en los términos de la sentencia de la Corte IDH. Además, dicha participación de las organizaciones en el diseño de la implementación fue expresamente ordenada por la Corte IDH en la sentencia junio de 2020. Por ello, en particular, se hace un llamado al Estado a que invite a las organizaciones representantes a participar en la Mesa interinstitucional creada para dar cumplimiento a la sentencia.

La Corte IDH señaló que mantendrá abierto su procedimiento de supervisión de cumplimiento al respecto de asegurar la no repetición mediante la adopción de acciones que permitan identificar y adoptar medidas para tratar la violencia sexual en el ámbito educativo. Por cuenta de ello, Ecuador deberá presentar al tribunal regional un informe sobre las reparaciones pendientes de cumplimiento a más tardar el próximo 21 de febrero de 2022.

Finalmente, es importante reiterar que, en su sentencia del caso, la Corte IDH no solo contempló órdenes específicas para Ecuador, sino que también reconoció derechos que tienen como eje central la educación sexual integral que aplican en América Latina y el Caribe. El Centro y CEPAM-Guayaquil instamos a los Estados de esta parte del continente a implementar cuanto antes los estándares de derechos humanos contenidos en el fallo del caso de Paola para que nadie más tenga que repetir su historia.
