Proyecto de Ley pone en riesgo justicia para más de 2.000 mujeres víctimas de esterilizaciones forzadas en el Perú

Lima. 13 de junio de 2024. (PRONUNCIAMIENTO) – Con profunda preocupación, DEMUS estudio para la defensa de los derechos de la mujer, el Centro de Derechos Reproductivos, y el Centro por la Justicia y el Derecho Internacional (CEJIL), en calidad de organizaciones defensoras de derechos humanos y representantes de Celia Ramos y familiares ante la Corte Interamericana de Derechos Humanos, expresamos nuestro rotundo rechazo al proyecto de ley que establece la prescripción de los delitos de lesa humanidad cometidos en Perú antes del 1 de julio de 2002.

Este proyecto de ley, que fue aprobado en primer debate por el Congreso de la República el pasado 06 de junio y pronto será sometido a una nueva votación, constituye una grave amenaza para que miles de víctimas del conflicto armado interno, incluidas las víctimas de esterilizaciones forzadas y las víctimas de violencia sexual, puedan acceder a la justicia y obtener reparación por las graves violaciones a sus derechos humanos y crímenes de lesa humanidad que han sufrido. Esto porque el proyecto establece que “nadie será procesado, condenado, ni sancionado por delitos de lesa humanidad o crímenes de guerra, por hechos cometidos con anterioridad al 01 de julio del 2002” (art. 5).

Si esta ley es aprobada, Celia Ramos y miles de mujeres que fueron sometidas a esterilizaciones forzadas entre 1995 y 2001, como parte de una política estatal que representó una forma de violencia institucional y reproductiva, serían afectadas pues se interrumpiría la investigación en contra de los funcionarios que estuvieron a cargo de implementarla, incluyendo al expresidente Alberto Fujimori y al entonces Ministro de Salud, Alejandro Aguinaga, quien es además congresista e impulsor de este proyecto de  ley.

Celia Ramos fue víctima de una esterilización forzada que llevó a su fallecimiento en 1997, en el marco de dicha política. Ella era una mujer campesina que acudió a un puesto de salud buscando atención odontológica. En el centro de salud y en visitas posteriores a su domicilio, Celia fue presionada para practicarse una esterilización quirúrgica a pesar de no desearlo, ni conocer los riesgos. Durante la cirugía tuvo complicaciones médicas que no fueron atendidas de manera adecuada y que le causaron la muerte.

Su caso no es un hecho aislado. En Perú se han presentado más de 2.000 denuncias penales por esterilizaciones forzadas ocurridas entre 1995 y 2001, aunque el número total de víctimas podría ser mucho más alto puesto que el gobierno de la época realizó más de 30.000 esterilizaciones quirúrgicas.

Dichas esterilizaciones forzadas constituyen crímenes de lesa humanidad, ya que se implementaron de forma sistemática como parte de una política pública que generó graves afectaciones a los derechos sexuales y reproductivos de miles de mujeres en Perú. En consecuencia, con base en los estándares internacionales en la materia, la obligación de investigar y sancionar estos delitos no prescribe y las personas responsables de estos crímenes deben ser identificadas, juzgadas y sancionadas. 

Cabe destacar que la Comisión Interamericana de Derechos Humanos (CIDH) ya expresó su preocupación por el avance de esta iniciativa, y recordó que la imprescriptibilidad de los crímenes de lesa humanidad y de guerra es un principio del derecho internacional que los Estados tienen la obligación de respetar. Asimismo, señaló que son inadmisibles las disposiciones que impidan la investigación y sanción de los responsables de estos delitos.

Es fundamental que el Estado peruano cumpla con sus obligaciones internacionales y asegure que los crímenes de lesa humanidad, como la esterilización forzada que sufrió Celia Ramos, sean investigados y sancionados adecuadamente. Instamos al Congreso de la República y a las autoridades peruanas a abstenerse de aprobar este proyecto de ley, que representa un grave retroceso en la lucha por la justicia y los derechos humanos.

DEMUS, el Centro de Derechos Reproductivos y el Centro por la Justicia y el Derecho Internacional, reafirmamos nuestro compromiso de continuar luchando por verdad, justicia y reparaciones integrales. No descansaremos hasta que todas las mujeres víctimas de esterilizaciones forzadas y otras violaciones de derechos humanos, así como sus familias, reciban la reparación y el reconocimiento que merecen.
