Presidenta Bachelet presenta proyecto de ley para despenalizar el aborto en Chile

(COMUNICADO DE PRENSA)
La Presidenta Michelle Bachelet de Chile presentó el pasado sábado un proyecto
de ley que permitiría a las mujeres acceder de manera segura y legal al aborto
en casos de violencia sexual, cuando la vida de la mujer esté en peligro y en
los casos que haya una inviabilidad del feto incompatible con la vida
extrauterina.


Si
se aprobara el proyecto de ley, Chile se convertiría en el 37° país que cambia
su ley para permitir el acceso al aborto legal y seguro en ciertas
circunstancias, dejando a un lado su prohibición total y las sanciones severas
que criminalizaban su práctica. Tras su elección en mayo de 2014, la Presidenta
Bachelet se comprometió a dar prioridad a la despenalización del aborto para
las mujeres de Chile.


Nancy
Northup, Presidenta y Directora Ejecutiva del Centro de Derechos Reproductivos
afirmó:


“Con
esta legislación, Chile tendría una oportunidad histórica para liderar el
camino hacia el empoderamiento pleno de la mujer, a través de la protección de
la salud y la seguridad de las mujeres, y el cumplimiento de los derechos
humanos fundamentales de las mujeres en Latinoamérica”.


“La
prohibición total del aborto en Chile ha obligado a innumerables mujeres a
realizarse abortos de manera clandestina, arriesgándose a ser encarceladas e
incluso poniendo en peligro sus vidas”.


“Aunque
aún hay mucho por hacer para eliminar las estrictas restricciones que han
criminalizado el acceso a los servicios de salud reproductiva durante mucho
tiempo en Chile, este es un primer paso muy importante”.


“Felicitamos
a la Presidenta Bachelet por colocar los derechos reproductivos de las mujeres
como una prioridad legislativa y exhortamos al Congreso a actuar con rapidez
para aprobar este proyecto de ley”.


El
proyecto de ley recientemente presentado, permitiría a las mujeres a acceder a
un aborto legal cuando su vida esté en peligro, en los casos que haya una
inviabilidad del feto incompatible con la vida extrauterina y en los casos de
violación, en las 12 primeras semanas de embarazo.


Si
bien la introducción de ésta legislación es un paso histórico e importante para
despenalizar el aborto en Chile, el proyecto de ley establece la autorización
de dos profesionales de la salud para proveer los servicios de aborto. El
proyecto tampoco contempla de manera explícita una excepción de la
criminalización en casos en que la salud de la mujer esté en peligro.


“Este
proyecto de ley es sin duda un paso positivo hacia la protección de los
derechos de la mujer, no obstante, como ha sido presentado se queda corto en la
protección de los derechos de salud y dignidad de las mujeres embarazadas”,
afirmó
Mónica Arango, Directora Regional para Latinoamérica y el Caribe del Centro de
Derechos Reproductivos.


El
aborto había sido legal de acuerdo a lo establecido en el Código de Salud
chileno de 1931, pero fue prohibido totalmente en septiembre de 1989. De 2001 a
2012, alrededor de 400.000 mujeres buscaron atención post-aborto en los
hospitales públicos chilenos.


Conforme
a un reciente informe del Centro publicado en el año 2014, 35 países han
reformado su legislación para expandir el acceso a servicios de abortos seguros
y legales en los últimos 20 años – una tendencia que ha marcado un gran
progreso para los derechos de las mujeres, reduciendo de manera significativa
las tasas de mortalidad materna debido a abortos inseguros. El informe fue
