The Equal Employment Opportunity Commission removed guidance on workplace harassment

The Equal Employment Opportunity Commission (EEOC), led by Andrea Lucas, voted 2-1 to rescind guidance on workplace harassment. The guidance document described how harassment based on protected characteristics, including race, sex, sexual orientation and gender identity, religion, age, and disability, is defined under federal law. Lucas cited President Trump’s anti-trans Executive Order to justify removing the guidance. Notably, the guidance was rescinded without the standard notice and comment period, meaning that the EEOC did not provide the public an opportunity to weigh in.
