HHS’s Office for Civil Rights rescinded guidance protecting nondiscriminatory access to medication abortion at pharmacies

The Department of Health and Human Services’ (HHS) Office for Civil Rights (OCR), led by Paula Stannard, rescinded 2023 guidance that clarified retail pharmacies’ obligations under federal anti-discrimination laws to stock and dispense certain drugs, even if those drugs can be used in the provision of abortion care. Specifically, the guidance, which was originally issued in 2022, was updated in 2023 to note that while pharmacies were not required to dispense drugs for the purpose of abortion, refusal to fill prescriptions for drugs used for other purposes may constitute sex and disability discrimination. The removal of this guidance will make it easier for pharmacies to decline to stock and dispense mifepristone, misoprostol, and methotrexate, which are essential medications for those who need them.
