New Tool Tracks State Abortion Cases
The Center for Reproductive Rights and Brennan Center for Justice have launched a new case tracker for abortion ban litigation at the state level
12.05.22 (PRESS RELEASE) —Today, the Center for Reproductive Rights and Brennan Center for Justice at NYU Law launched a new tool that tracks all abortion ban cases filed in state courts since the Supreme Court overruled Roe v. Wade. The tracker will allow people to check the status of these cases, including case documents and court orders. Since Roe was overturned in June, there has been a flood of new cases filed in state courts across the country to challenge various abortion bans.
“There has been legal chaos in many states since the Supreme Court’s radical decision to overturn Roe v. Wade,” said Diana Kasdan, Director of Judicial Strategies at the Center for Reproductive Rights. “State politicians wasted no time criminalizing abortion by activating bans that had been unenforceable under Roe, and organizations like the Center have been filing lawsuits in state court to try to stop them. With state courts now deciding whether state law protects abortion rights and access, this tracker is an important tool for following legal developments state-by-state.”
Since Roe fell, a total of 34 cases have been filed challenging abortion bans in 19 states, of which 31 remain pending at either the trial or appellate levels. State legislatures will be reconvening in January 2023 and are expected to pass more abortion bans, and this resource will continue to track any new challenges filed in state courts.
The 19 states with litigation against abortion bans, all covered in the tracker, include: Arizona; Florida; Georgia; Idaho; Indiana; Iowa; Kentucky; Louisiana; Michigan; Mississippi; North Dakota; Ohio; Oklahoma; South Carolina; Texas; Utah; West Virginia; Wisconsin; and Wyoming.
The State Court Abortion Litigation Tracker will be updated monthly. In this tracker, the Brennan Center for Justice and the Center for Reproductive Rights aggregate pending and completed state court litigation against bans that were, or would have been, unconstitutional under Roe. This does not cover all laws impacting abortion access in the states — for information on the current laws and status of access in each state, please see the Center for Reproductive Rights’ interactive map.
