Điều 44
Quyền của phụ nữ được khám bệnh, chữa bệnh phụ khoa và nạo thai, phá thai.
1- Phụ nữ được quyền nạo thai, phá thai theo nguyện vọng, được khám bệnh, chữa bệnh phụ khoa, được theo dõi sức khoẻ trong thời kỳ thai nghén, được phục vụ y tế khi sinh con tại các cơ sở y tế.
2- Bộ y tế có trách nhiệm củng cố, phát triển mạng lưới chuyên khoa phụ sản và sơ sinh đến tận cơ sở để bảo đảm phục vụ y tế cho phụ nữ.
3- Nghiêm cấm các cơ sở y tế và cá nhân làm các thủ thuật nạo thai, phá thai, tháo vòng tránh thai nếu không có giấy phép do Bộ y tế hoặc Sở y tế cấp.

Điều 243. Tội phá thai trái phép
1. Người nào thực hiện việc phá thai trái phép cho người khác gây thiệt hại cho tính mạng hoặc gây thiệt hại nghiêm trọng cho sức khoẻ của người đó hoặc đã bị xử lý kỷ luật, xử phạt hành chính về hành vi này hoặc đã bị kết án về tội này, chưa được xoá án tích mà còn vi phạm, thì bị phạt cải tạo không giam giữ đến ba năm hoặc bị phạt tù từ một năm đến năm năm.
2. Phạm tội gây hậu quả rất nghiêm trọng thì bị phạt tù từ ba năm đến mười năm.
3. Phạm tội gây hậu quả đặc biệt nghiêm trọng thì bị phạt tù từ bảy năm đến mười lăm năm.
4. Người phạm tội còn có thể bị phạt tiền từ năm triệu đồng đến năm mươi triệu đồng, cấm đảm nhiệm chức vụ, cấm hành nghề hoặc làm công việc nhất định từ một năm đến năm năm.

Women’s rights to gynecological care and to undergo abortion
44.
(1) Women shall be entitled to have an abortion if they so desire, to undergo medical examinations and treatment for gynecological diseases and to receive prenatal care and medical services during delivery at medical institutions.
(2) The Ministry of Public Health shall have the duty to consolidate and expand the network of obstetric and neonatal health care to the grassroots level, in order to ensure medical care for women.
(3) Medical institutions and individuals may not perform abortions or remove IUDs unless permitted to do so by the Health Ministry or [competent] services.

Article 243.- Illegal abortion
1. Those who perform illegal abortions for other persons, causing loss of lives or serious damage to the health of such persons, or who have already been disciplined or administratively sanctioned for such act or already sentenced for such offense, not yet entitled to criminal record remission but continue to commit it, shall be sentenced to non-custodial reform for up to three years or between one and five years of imprisonment.
2. Committing the crime and causing very serious consequences, the offenders shall be sentenced to between three and ten years of imprisonment.
3. Committing the crime and causing particularly serious consequences, the offenders shall be sentenced to between seven and fifteen years of imprisonment.
4. The offenders may also be subject to a fine of between five million dong and fifty million dong, a ban from holding certain posts, practicing certain occupations or doing certain jobs for one to five years.
