Senegal’s Abortion Provisions in French

Loi de base nº 65-60 du 21 juillet 1965 portant code pénal, Titre deuxième, Chapitre premier, Section II, Articles 305 et 305 bis

Article 305

Quiconque, par aliments, breuvages, médicaments, manoeuvres, violences, ou partout autre moyen, aura procuré ou tenté de procurer l’avortement d’une femme enceinte, qu’elle y ait consenti ou non, sera puni d’un emprisonnement d’un an à cinq ans et d’une amende de 20.000 à 100.000 francs.

L’emprisonnement sera de cinq à dix ans et l’amende de 50.000 à 500.000 francs s’il est établi que le coupable s’est livré habituellement aux actes visés à l’alinéa précédent.

Sera punie d’un emprisonnement de six mois à deux ans et d’une amende de 20.000 à 100.000 francs, la femme qui se sera procurée l’avortement à elle-même ou aura tenté de se le procurer, ou qui aura consenti à faire usage des moyens à elle indiqués ou administrés à cet effet.

Les médecins, les pharmaciens et toute personne exerçant une profession médicale, paramédicale ainsi que les étudiants en médecine, les étudiants ou employés en pharmacie, herboristes, bangagistes, marchands d’instruments de chirurgie, qui auront indiqué, favorisé ou pratiqué les moyens de procurer l’avortement, seront condamnés aux peines prévues aux alinéas premier et second du présent article.

La suspension pendant cinq ans au moins ou l’incapacité absolue de l’exercice de leur profession seront, en outre, prononcées contre les coupables.

Quiconque contrevient à l’interdiction d’exercer sa profession prononcée en vertu de l’alinéa precedent sera puni d’un emprisonnement de six mois au moins et de deux ans au plus et d’une amende de 100.000 à 500.000 francs ou de l’une de ces deux peines seulement.

Il ne pourra être pronounce le sursis à l’exécution de la peine lorsque le coupable sera l’une des personnes énoncées à l’alinéa 4.

Article 305 bis

(Loi n° 80-49 du 24 décembre 1980)

Sera puni d’un emprisonnement de six mois à trois ans et d’une amende de 50.000 francs à 1.000.000 de francs, ou de l’une de ces deux peines seulement, quiconque:

–  soit par des discours proférés dans les lieux ou réunions publics;

–  soit par la vente, la mise en vente ou l’offre, même non publique, ou par l’exposition, l’affichage ou la distribution sur la voie publique ou dans les lieux publics, ou par la distribution à domicile, la remise sous bande ou sous envelope fermée ou non fermée, à la poste ou à tout agent de distribution ou de transfert, de livres, d’écrits, d’imprimés, d’annonces, d’affiches, dessins, images et emblèmes;

–  soit par la publicité de cabinets médicaux ou prétendus tels, aura provoqué au délit d’avortement, alors même que cette provocation n’aura pas été suivie d’effet.

Sera puni des memes peines quiconque aura vendu, mis en vente ou fait vendre, distribué ou fait, distribuer, de quelque manière que ce soit, des remèdes, substances, instruments ou objets quelconques, sachant qu’ils étaient destinés à commettre le délit d’avortement, lors même que cet avortement n’aurait été ni consommé, ni tenté, et alors même que ces remèdes, substances, instruments ou objets quelconques proposés comme moyens d’avortement efficace seraient en réalité inaptes à le réaliser.


Senegal’s Abortion Provisions in English (Unofficial Translation)

Basic law nº 65-60 of 21 July 1965 on the penal code, Second Title, First Chapter, Section II, Articles 305 and 305 bis.

Article 305
Whoever by food, drink, medications, actions, violence, or by any other means has procured or attempted to procure the abortion of a pregnant woman, whether she has consented to it or not, shall be punished with imprisonment of one to five years and a fine of 20,000 to 100,000 francs.

The imprisonment shall be five to ten years and the fine 50,000 to 500,000 francs if it is established that the guilty person is regularly engaged in the acts referred to in the preceding paragraph.

A woman who has procured the abortion herself or has attempted to procure it, or has consented to make use of means indicated or administered to this effect shall be punished with imprisonment of six months to two years and a fine of 20,000 to 100,000 francs.

Physicians, pharmacists, and any person exercising a medical or para-medical profession, as well as medical students, pharmacy students or employees, herbalists, medical store personnel, and sellers of surgical instruments who have indicated, promoted or practiced means to procure an abortion shall be convicted of the penalties provided for in the first and second paragraphs of this article. ,

In addition, suspension for at least five years or an absolute ban from exercising their profession shall be ordered against the guilty persons.

Whoever contravenes the ban from exercising his/her profession ordered pursuant to the preceding paragraph shall be punished with imprisonment of at least six months and at most two years and/or a fine of 100,000 to 500,000 francs.

A stay of execution of the penalty may not be ordered when the guilty person is one of the persons set out in paragraph 4. 

Article 305 bis
(Law n°, 80-49 of 24 December 1980)

Whoever has provoked the crime of abortion, even when this provocation has not had effect, shall be punished with imprisonment of six months to three years and/or a fine of 50,000 to 1,000,000 francs:

– either by speech uttered in public places or meetings,

– either by selling, offering for sale or supplying, even if not public, or by the exhibition, display or distribution on a public street or in public places, or by home delivery, placing within wrappers or in sealed or unsealed envelopes, at the post office or any agent of distribution of transfer of books, writings, printed advertisements, posters, drawings, images, and symbols,

– either by advertisements in medical or so-called medical offices.

Whoever has sold, offered for sale or caused to be sold, distributed or caused to be distributed in any manner whatever, any remedies, substances, instruments, or objects, knowing that they were intended for committing the crime of abortion even when this abortion was not carried out or attempted and even when any of these remedies, substances, instruments, or objects proposed as means for an effective abortion would be actually unfit to achieve it, shall be punished with the penalties.
