Código Penal (1991), Ley de 3 Abril 1991, Capitulo II, Artículos 114 – 120

Capitulo II. Aborto

Artículo 114o. La mujer que causa su aborto, o consiente que otro le practique, será reprimida con pena privativa de libertad no mayer de dos años o con prestación de servicio communitario de cincuentidós a ciento cuatro jornadas.

Artículo 115o. El que causa el aborto con el consentimiento de la gestante, será reprimido con pena privativa de libertad no menor de uno ni mayor de cuatro años.

Si sobreviene la muerte de la mujer y el agente pudo prever este resultado, la pena será no menor de dos ni mayor de cinco años.

Artículo 116o. El que hace abortar a una mujer sin su consentimiento, será reprimido con pena privativa de libertad no menor de tres ni mayor de cinco años.

Si sobreviene la muerte de la mujer y el agente pudo prever este resultado, la pena será no menor de cinco ni mayor de diez años.

Artículo 117o. El médico, obstétra, farmacéutico, o cualquier profesional sanitario, que abusa de su ciencia o arte para causar el aborto, será reprimido con la pena de los artículos 115o. y 116o. e inhabilitación conforme al artículo 36o., incisos 4 y 8.

Artículo 118o. El que, con violencia, ocasiona un aborto, sin haber tenido el propósito de causarlo, siendo notorio o constándole el embarazo, será reprimido con pena privativa de libertad no mayor de dos años, o con prestación de servicio comunitario de cincuentidós a ciento cuatro jornadas.

Artículo 119o. No es punible el aborto practicado por un médico con el consentimiento de la mujer embarazada o de su representante legal, si lo tuviere, cuando es el único medio para salvar la vida de la gestante o para evitar en su salud un mal grave y permantente.

Artículo 120o. El aborto será reprimido con pena privativa de libertad no mayor de tres meses:

1. Cuando el embarazo sea consecuencia de violación sexual fuera de matrimonio o inseminación artificial no consentida y ocurrida fuera de matrimonio, siempre que los hechos hubieren sido denunciados o investigados, cuando menos policialmente, o,

2. Cuando es probable que el ser en formación conlleve al nacimiento graves taras físicas o psíquicas, siempre que exista diagnóstico médico.

Resolución Ministerial No. 486- 2014/MINSA, Aprueban la “Guía Técnica Nacional para la estandarización del procedimiento de la Atención Integral de la gestante en la Interrupción Voluntaria por Indicación Terapéutica del Embarazo menor de 22 semanas con consentimiento informado en el marco de lo dispuesto en el artículo 119º del Código Penal” (2014)

Penal Code (1991), Law of April 3, 1991, Chapter II, Articles 114-120

Chapter II. Abortion

Article 114th. The woman that causes her abortion, or consents to another performing it, will be punished with the penalty of imprisonment of no more than two years or with community service from fifty two to one hundred four days.

Article 115th. He who causes the abortion with the consent of the pregnant woman, shall be punished with imprisonment for no less than one and no more than four years.

If the death of the woman follows and the actor could have foreseen this result, the penalty shall be no fewer than two and no more than five years.

Article 116th. He who causes a woman to abort without her consent, shall be punished with the penalty of imprisonment for no fewer than three and no more than five years.

If the death of the woman follows and the actor could have foreseen this result, the penalty shall be no fewer than five and no more than ten years.

Article 117th. The doctor, obstetrician, pharmacist or any health professional, who abuses his science or art to cause an abortion, shall be punished by the penalty from the 115th and 116th articles and disqualification according the 36th article, paragraphs 4 and 8.

Article 118th. He who, by violence, causes an abortion, without having the intent of causing one, being flagrant or causing the loss of the pregnancy, shall be punished with imprisonment of no more than two years, or with community service from fifty two to one hundred four days.

Article 119th. Abortion performed by a doctor with the consent of the pregnant woman or her legal representative, if she has one, is not punishable, when it is the only means to save the life of the pregnant woman or to avoid grave and permanent harm to her health.

Article 120th. Abortion shall be punished with imprisonment of no more than three months:

1. When the pregnancy is the result of rape outside of marriage or artificial insemination without consent outside of marriage, provided the facts have been reported or investigated, at least by the police, or,

2. When it is likely that the fetus would be born with serious physical or psychological defects, provided there is a medical diagnosis.
