Côte d’Ivoire’s Abortion Provisions in French

Code Pénal, Loi n° 2019-574 du 10 juillet 2019, Chapitre III, Section 3, Articles 425-429

Article 425

Constitue l’avortement, l’emploi d’aliments, breuvages, médicaments, substances, mangeures, violences ou de tout autre moyen en vue de provoquer l’expulsion prématurée de l’embryon ou du fœtus, quel que soit le moment de la grossesse oïl cette expulsion est pratiquée, que la femme y ait consenti ou non.

Est puni de l’emprisonnement d’un a cinq ans et d’une amende de 150.000 à 1.500.000 francs, quiconque commet ou tente de commettre un avorta.

L’emprisonnement est de cinq à dix   ans   et l’amende de 1.000.000 à 10.000.000 de francs, si !’auteur se livre habituellement aux acres vises à l’alinéa I.

L’emprisonnement est de deux à cinq ans et l’amende 200.000 à 2.000.000 de francs s’il en est résulté une stérilité, des atteintes graves a la santé physique, gynécologique OU mentale de la victime,

L’emprisonnement est de dix à vingt ans s’il en est résulté la mort de la victime.

Article 426

Est puni d’un emprisonnement de six mois a deux ans et d’une amende de 50.000 à 500.000 francs, la femme qui se procure l’avortèrent a elle- même ou tente de se le procurer, ou qui consent à faire usage des moyens a elle indique ou administres à cet effet.

Les personnes appartenant au corps médical ou à une profession touchant à la sante publique qui indiquent, favorisent ou mettent eux-mêmes en émeuve les moyens de procurer l’avortement sont punies des peines prévues aux alinéas 2 et 3 de l’article précèdent.

Toute condamnation prononcée par application de I ‘article 425 et du présent article comporte de plein droit, !’interdiction d’exercer route fonction et de remplir tout emploi, à quelque titre que ce soit, dans les cliniques d’accouchement, maisons d’accouchement et tous établissements prives recevant habituellement à titre onéreux ou gratuit, et en nombre quelconque, des femmes en état réel, apparent ou présume de grossesse.

En cas de condamnation prononcée par une juridiction étrangère et passée en force de chose jugée pour une infraction constituant d’après la loi ivoirienne un des délits spécifies à la présente section, le tribunal correctionnel du domicile du condamne prononce, à la requête du ministère public, l’intéresse dument appeler en la chambre du conseil, I ‘interdiction visée à l’alinéa précèdent.

Article 427

II n’y a pas d’infraction lorsque :

1 ° interruption de la grossesse est nécessitée par la sauvegarde de la vie de la mère gravèrent menacée;

2° le médecin procure l’avortement a une victime de viol à la demande de celle-ci.

Dans ces cas, le médecin traitant ou le chirurgien doit prendre l’avis de deux médecins consultants, qui, après examen, attestent que la vie de la mère ne peut être sauvegardée qu’au moyen d’une telle intervention chirurgicale ou thérapeutique ou que telle était la volonté de la victime de viol, dument constatée par écrit.

Si le nombre de médecin résidant au lieu de l’intervention est de deux, le médecin traitant n’est tenu de prendre que l’avis de son confrère,

Si le médecin traitant est seuil résidant au lieu de l’intervention, ii atteste sur son honneur que la vie de la mère ne pouvait être sauvegardée que par l’intervention chirurgicale ou thérapeutique pratiquée ou que telle était la volonté de la victime de viol.

Dans tous les cas, un des exemplaires de la consultation est remis à la mère. L’autre est conserve par le ou les médecins traitants.

Article 428

Est puni d’un emprisonnement de six mois a trois ans et d’une amende de I 00.000 à 1.000.000 de francs, quiconque provoque au délit d’avortement, alors marne que cette provocation ne serait pas suivie d’effet :

1° soit par des discours profères dans les lieux ou réunions publics ;

2° soit par la vente, la mise en vente ou l’offre ; même non publique ou par l’exposition, l’affichage ou la distribution sur la voie publique ou dans les lieux publics, ou par la distribution à domicile, la remise   sous bande ou sous enveloppe fermée, de livres, écrits, imprimes, annonces, affiches, dessins, images, emblèmes ;

3° soit par la publicité de cabinets médicaux agrées ou non.

Article 429

Est puni des peines prévues à l’article précèdent, quiconque vend, met en vente, fait vendre, distribue où faire distribuer de quelque manière que ce soit, des rendes, substances, instruments ou objets quelconques, sachant qu’ils étaient destinés à commettre le défi d’avortement, alors marne que cet avortement ne serait ni conforme, ni tente ou que lesdits objets seraient en réalité inaptes à le provoquer.

Penal Code, Law No. 2019-574 of July 10, 2019, Chapter III, Section 3, Articles 425-429

Article 425

Abortion constitutes the use of food, beverages, drugs, substances, maneuvers, violence or any/all other means to cause the premature expulsion of the embryo or fetus, regardless of the time during the pregnancy when this expulsion is practiced, whether the woman has consented or not.

Any person who commits or attempts to commit an abortion is punished by imprisonment from one to five years and a fine of 150,000 to 1,500,000 francs.

  • The imprisonment is five to ten years and the fine of 1,000,000 to 10,000,000 francs, if the culprit habitually engages in acts referred to in paragraph 1 above.
  • The imprisonment is two to five years and the fine 200,000 to 2,000,000 francs if the act resulted sterility, serious injury to the physical, gynecological or mental health of the victim.

Imprisonment is ten to twenty years if the act results in the death of the victim.

Article 426

A woman who procures the abortion to herself or tries to obtain it, or who consents to make use of the means indicated (suggested) to her or administered, for the purpose of procuring an abortion, is punished by imprisonment from six months to two years and a fine of 50,000 to 500,000 francs.

Persons belonging to the medical profession or to a profession affecting public health who indicate/suggest, promote or implement themselves, the means of procuring abortion are punishable by the penalties provided for in paragraphs 2 and 3 of the preceding Article (Article 425).

Any conviction pronounced by application of Article 425 and of this article entails by that fact, the prohibition to exercise any function and to fill any employment, for any reason whatsoever, in the delivery clinics, houses of childbirth and all private establishments usually receiving, for consideration/ a fee, or free of charge, and in any/whatever number, women in real, apparent or assumed pregnancy.

Article 427

There is no offence when-

  1. The interruption of the pregnancy is necessary to safeguard the life of the mother that is seriously threatened;  
  2. The doctor provides abortion to a rape victim at her request.

In these cases, the attending doctor or surgeon must seek the advice of two consulting doctors who, after examination, certify that the life of the mother can only be saved by such a surgical or therapeutic procedure or that such was the will of the rape victim, duly noted in writing.

If the number of resident doctors at the place of the intervention is two, the attending doctor is only required to take the opinion of his colleague.

If the attending doctor is the only resident of the place of the intervention, he testifies on his honor that the life of the mother could only be safeguarded by the surgical or therapeutic operation practiced/undertaken or that such was the will of the rape victim.

Article 428

Anyone who commits the crime of abortion (see how in the list below), even though this provocation would not be/is not followed by the effect, is punished by imprisonment from six months to three years and a fine of 100,000 to 1,000,000 francs.

  1. Either by speeches made at public places or meetings;
  2. Either by sale, offer for sale or offer; even when not public or by exhibition, display or distribution on public roads or in public places, or by the distribution at home, the delivery in band or in closed envelope, of books, writings, printed matter, announcements, posters, drawings, images, emblem;
  3. Either by the advertising of licensed medical practices or not.

Article 429

Any person who sells, offers for sale, sells, distributes or causes to be distributed in any manner whatsoever, remedies, substances, instruments or objects of any kind, knowing that they were destined to commit abortion, is punishable by the penalties provided for in the preceding article (Article 428), even though this abortion is not be consumed or attempted or the said objects would in fact be incapable of causing the abortion.
