The brief argues that allowing states to force abortion clinics to close will worsen existing health disparities for LGBTQ people who use services that abortion and reproductive health care providers offer, and face barriers to accessing alternative sources of health care.

Drawing on a long history of similar attempts, the brief urges the Supreme Court to reject Louisiana’s efforts to undermine fundamental rights by asserting a pretextual, scientifically unsupported health and safety rationale.

Amici also recount that since Obergefell v. Hodges, states have sought to defend laws that discriminate against LGBTQ people’s right to marry by arguing that they serve a purpose unrelated to marriage, and are factually distinct – the same argument that Louisiana makes here. The Supreme Court has rejected those attempts and should again in June Medical.
