La ley de impunidad en Perú es una nueva violación a  las víctimas de esterilizaciones forzadas

Lima, Perú. 15 de agosto de 2024. (Pronunciamiento) – DEMUS – Estudio para la Defensa de la Mujer, el Centro de Derechos Reproductivos (CDR),  el Centro por la Justicia y el Derecho Internacional (CEJIL), el Comité de América Latina y el Caribe para la Defensa de los Derechos de las Mujeres (CLADEM), y la Asociación Pro Derechos Humanos (APRODEH), expresamos nuestro repudio  a la promulgación de la Ley No. 32107, que establece la prescripción de los delitos de lesa humanidad cometidos en Perú antes del 1 de julio de 2002. 

Como organizaciones que representan a Celia Ramos y familiares ante la Corte Interamericana de Derechos Humanos (Corte IDH), y a Mamérita Mestanza y familiares ante la Comisión Interamericana de Derechos Humanos (CIDH), consideramos que esta ley podría llevar a la impunidad de miles de casos de graves violaciones a los derechos humanos, transgrediendo los principios más básicos del acceso a la justicia y generando un dolor enorme e irreparable para miles de víctimas del conflicto armado interno en el Perú.

Celia Ramos y María Mamérita Mestanza fueron dos de las más de 2.000 mujeres, en su mayoría indígenas, campesinas y en situación de pobreza, que fueron presionadas para someterse a una esterilización quirúrgica en el marco del Programa Nacional de Salud Reproductiva y Planificación Familiar (PNSRPF), conducido durante la dictadura de Alberto Fujimori, entre los años 1995 y 2001. Ambas mujeres fallecieron a raíz de estos procedimientos.

La ley de impunidad contradice abiertamente lo ordenado por la Corte IDH que, en su más reciente decisión del pasado 1° de julio, en el marco de los casos Barrios Altos y La Cantuta contra Perú, ordenó al Estado abstenerse de adoptar y otorgar vigencia al proyecto de ley No. 6951/2023-CR que dispone la prescripción de los crímenes de lesa humanidad perpetrados en el Perú. Ante el desacato por parte del Estado peruano, este proyecto ahora es ley.

La Corte le reiteró al Estado peruano que son inadmisibles las disposiciones de amnistía o prescripción que impidan la investigación y sanción de los responsables de graves violaciones de derechos humanos. Además, recordó que la prohibición de los crímenes de lesa humanidad es una norma imperativa del derecho internacional, esto significa que la comunidad internacional reconoce la obligación de los Estados de prevenir tales conductas y, en caso de incumplirlo, su deber de asegurar que los responsables sean perseguidos penalmente. 

Condenamos la aprobación de esta ley que abre la puerta para que se interrumpa la investigación contra los funcionarios que estuvieron a cargo de implementar el programa de esterilizaciones forzadas. Recordemos que actualmente se viene tramitando en Chile un proceso de extradición contra Alberto Fujimori por diversos casos, desde corrupción y violación de derechos humanos, y por supuesto el caso de esterilizaciones forzadas.

Instamos a los jueces y juezas de la República del Perú a ejercer el control de convencionalidad al evaluar la aplicación de esta ley debido a que es incompatible con los tratados internacionales de derechos humanos ratificados por el país y lo ordenado por la Corte IDH. Extendemos el llamado a la comunidad internacional, para que condenen la promulgación de esta ley y acompañen de manera firme la lucha por la justicia y la reparación integral para las víctimas de los crímenes de lesa humanidad.

Al aprobar esta ley, el Estado peruano incumple con sus obligaciones internacionales. exigimos que sea revertida y que se asegure que los crímenes de lesa humanidad, como las esterilizaciones forzadas que sufrieron Celia Ramos y Mamérita Mestanza, sean investigados y sancionados adecuadamente.
