La Corte Constitucional colombiana reafirma que el Procurador General de la Nación debe proporcionar información exacta y confiable sobre los derechos sexuales y reproductivos

(COMUNICADO DE PRENSA) De acuerdo a una decisión de la Corte Constitucional, publicada el 12 de septiembre de 2012, el Procurador General de la Nación de
Colombia –máxima autoridad de una de las instituciones responsables de garantizar los derechos fundamentales de todas las personas– y dos de las
Procuradoras delegadas violaron sus obligaciones como funcionarios públicos al dar información inexacta y parcializada en materia de derechos sexuales y
reproductivos.



El Procurador Alejandro Ordóñez y las Procuradoras delegadas María Eugenia Carreño e Ilva Myriam Hoyos, distribuyeron documentos oficiales que contenían
información incorrecta en temas de salud y derechos reproductivos. Algunas de las afirmaciones falsas realizadas por los funcionarios son que la
anticoncepción de emergencia es abortiva, que las instituciones de salud y su personal tienen derecho a denegar, sin ninguna limitación, el acceso de las
mujeres al aborto legal, basados en objeciones morales y religiosas, y que no existe en Colombia un derecho de acceso al aborto seguro. De acuerdo con la
sentencia de la Corte las acciones de los funcionarios de la Procuraduría amenazaron el derecho a la dignidad, la vida, y la salud física y mental de las
mujeres, así como su derecho a acceder a servicios de salud reproductiva.



“Los funcionarios de la Procuraduría violaron la Constitución al suministrar información falsa acerca de la salud reproductiva –poniendo en riesgo la salud
de millones de mujeres,” dijo Mónica Arango, Directora Regional para América Latina y el Caribe, Centro de Derechos Reproductivos. “La Corte Constitucional
Colombiana tomó un paso determinante para defender el derecho fundamental de las mujeres a recibir información veraz y exacta sobre sus derechos sexuales y
reproductivos por parte del gobierno”.



En vez de respetar y proteger los derechos de las mujeres, como lo requiere su cargo, los funcionarios de la Procuraduría han buscado activamente conseguir
su desmantelamiento. Women´s Link Worldwide, organización internacional con sede en Colombia, que trabaja por la equidad de género, presentó el caso ante
la justicia en septiembre de 2011, en conjunto con cerca de 1200 mujeres. En mayo, el Centro de Derechos Reproductivos se unió a la lucha de Women´s Link
Worldwide para proteger los derechos sexuales y reproductivos de las mujeres y niñas en Colombia, por medio de la presentación de un amicus curie
ante la Corte.



La intervención del Centro argumentó que la información falsa que publicaron los funcionarios de la Procuraduría puso en riesgo la responsabilidad del
Estado colombiano en el cumplimiento de las obligaciones contraídas a partir de la ratificación de instrumentos internacionales como laConvención sobre la Eliminación de todas las Formas de Discriminación contra la Mujer y el Pacto Internacional de Derechos Civiles y Políticos. En la intervención ante la Corte se demostró
que los funcionarios de la Procuraduría habían amenazado y en algunos casos violado los derechos sexuales y reproductivos de las mujeres, incluyendo el
derecho a recibir información sobre su salud, lo que equivale a una violación al derecho a la salud.



Durante los últimos años, Colombia ha demostrado un compromiso creciente en la promoción y protección de los derechos de las mujeres. El 10 de mayo de
2006, la Corte Constitucional colombiana estableció que el aborto era un derecho fundamental, como mínimo, cuando la continuación del embarazo supone un
riesgo para la vida, la salud física o mental de la mujer, cuando el embarazo sea resultado de una conducta ilegal, o cuando exista grave malformación del
feto que haga inviable su vida.



En el fallo, la Corte Constitucional le ordenó al Procurador y a las Procuradoras delegadas rectificar la información y las afirmaciones inexactas que han
realizado en temas de derechos sexuales y reproductivos. Como resultado de la decisión de la Corte, las Procuradoras delegadas Carreño y Hoyos presentaron
sus cartas de renuncia ante el Procurador Ordóñez.
