La Comisión Interamericana de Derechos Humanos Hace un Llamado Para un Mejor Acceso a Servicios de Salud Reproductiva

(COMUNICADO DE PRENSA) La Comisión Interamericana de Derechos Humanos (CIDH)
– el principal organismo de derechos humanos para las Américas- publicó un
pronunciamiento subrayando que las leyes que criminalizan el aborto en todas
las circunstancias tienen un impacto negativo en la dignidad de las mujeres y
en su derecho a la vida, a la integridad personal, y a la salud, a la vez que
en su derecho en general a vivir una vida libre de violencia y
discriminación. , El Centro de Derechos
Reproductivos celebra el llamado que hace la CIDH ,a todos los Estados para que adopten medidas
inmediatas para garantizar que las mujeres puedan ejercer plenamente todos los
derechos sexuales y reproductivos.


La Comisión
expresó que los Estados tienen la obligación fundamental de garantizar el
acceso oportuno y adecuado a servicios de salud que solo mujeres, niñas y
adolescentes necesitan por su sexo, género y función reproductora, libres de
toda forma de discriminación y violencia, de conformidad con los compromisos
internacionales existentes sobre igualdad de género. ,


En países
como El Salvador, la criminalización absoluta del aborto ha resultado en el encarcelamiento
de más de 25 mujeres que sufrieron complicaciones y abortos involuntarios
relacionados con el embarazo y que luego fueron acusadas de haber abortado e
injustamente condenadas por homicidio agravado hasta por 30 años en prisión.


Catalina
Martínez Coral, Directora Regional para América Latina y el Caribe en el Centro,
se pronunció:


“La criminalización del aborto es un ataque a la dignidad,
salud y vida de las mujeres.


“Resaltamos la importancia del pronunciamiento de las ,Relatoras de la CIDH para el ejercicio de los
derechos reproductivos de ,todas las
mujeres y niñas.


,”Esperamos
que la CIDH continúe exhortando a los Estados para que creen políticas públicas
significativas que protejan los derechos sexuales y reproductivos.


América
Latina y el Caribe tiene algunas de las políticas más restrictivas contra el
aborto en el mundo y, como resultado, tiene las tasas más altas de abortos
inseguros, con la excepción del este de África. El Salvador, Honduras,
República Dominicana, Suriname, Haití y Nicaragua continúan criminalizando el
aborto, incluso cuando la vida y la salud de las mujeres están en peligro,
poniendo a las mujeres y niñas en un riesgo innecesario.


El Centro
de Derechos Reproductivos ha trabajado para exponer las consecuencias que las
prohibiciones generales del aborto tienen sobre la vida de las mujeres. En
2015, junto con la Agrupación Ciudadana, el Centro presentó un caso en nombre
de nueve mujeres que tenían graves complicaciones en el embarazo y ahora están
en prisión debido a la aplicación severa de la prohibición absoluta de aborto
de El Salvador. La Comisión también admitió el caso de Manuela, otra mujer
salvadoreña injustamente encarcelada después de tener una emergencia obstétrica
que luego murió en prisión por un linfoma de Hodgkin no tratado.


En mayo del
2017, la Comisión organizó una audiencia sobre Derechos Reproductivos en Chile,
donde el Centro de Derechos Reproductivos, Miles Chile y la Fundación Isabel
Allende, testificaron ante la Comisión con la finalidad de que el Estado de
Chile pudiese priorizar la aprobación de la ley sobre interrupción voluntaria
del embarazo. En agosto del presente año, el Tribunal Constitucional de Chile aprobó
el proyecto de ley que permitirá a las mujeres acceder a servicios de aborto
seguro y legal en casos en los que el embarazo ponga en riesgo la vida de la
mujer, sea el resultado de una violación o cuando el feto sufra de
malformaciones incompatibles con la vida extrauterina.


El Centro
también ha trabajado en casos en Perú, Brasil, Ecuador y Costa Rica para
garantizar los derechos humanos de las mujeres en la región. , En el actual periodo de sesiones de la CIDH,
el Centro sostuvo una audiencia con otras organizaciones que trabajan en la
región sobre violencia sexual contra niñas y la falta de acceso al cuidado
reproductivo.
