Amici are cities, counties, and local government entities from across the country.
In the brief, 28 local governments highlight their shared interests and responsibility to provide for the health and safety of their communities, which includes ensuring access to reproductive health care. Local governments argue that the government is likely to succeed on the merits of this case and that the plaintiff’s two-decade delay undermines their arguments for preliminary relief. Amici also urge that failing to issue a stay of the district court’s order will result in confusion and inconsistent implementation due to the complexity of the issues and the competing ruling in Washington. They also argue that the public interest and public confidence in the judiciary demand a stay and complete review of the district court’s decision before any of its harmful impacts are realized.
This brief was one of many filed in support of the FDA in Alliance for Hippocratic Medicine v. FDA. For more information on the case, click here.
