Local governments argue that the government is likely to succeed on the merits of this case and that the plaintiff’s two-decade delay undermines their arguments for preliminary relief. Amici also urge that failing to issue a stay of the district court’s order will result in confusion and inconsistent implementation due to the complexity of the issues and the competing ruling in Washington. They also argue that the public interest and public confidence in the judiciary demand a stay and complete review of the district court’s decision before any of its harmful impacts are realized.
