El Centro de Derechos Reproductivos le pide a Brasil que repare a la familia de Alyne de acuerdo a la decisión histórica del caso Alyne c. Brasil.



En agosto de 2011 el Comité para la Eliminación de la Discriminación contra la Mujer de la Organización de Naciones Unidas (Comité
CEDAW) falló en favor de las mujeres de todo el mundo al reconocer—en el primer caso de mortalidad materna prevenible decidido por un organismo
internacional de derechos humanos—que los Estados tienen una obligación ineludible de garantizar servicios de salud materna a todas las mujeres,
independientemente de sus circunstancias.



El Comité CEDAW determinó la responsabilidad del Estado brasileño por

la muerte trágica y completamente prevenible de Alyne da Silva Pimentel
, una mujer afro-brasileña a quien le fue repetidamente negado el cuidado médico de calidad y oportuno que requería. El fallo histórico
del Comité CEDAW determinó que el Estado debía reparar a su hija y a su madre por las violaciones a los derechos humanos de Alyne.



Un año ha pasado, y nada ha cambiado. Si bien Brasil ha reducido significativamente su tasa de muertes maternas en los últimos años, el
Estado tiene mucho camino por recorrer para garantizar las vidas de mujeres embarazadas pobres, rurales, y de ascendencia africana, quienes son el sector
de la población que encuentra mayores dificultades y obstáculos para el acceso a servicios de salud reproductiva de calidad. Cuando una
violación del derecho internacional no ha sido totalmente reparada, esta violación persiste.



El Centro ha sostenido varias reuniones constructivas con las autoridades brasileñas sobre el proceso de implementación de la decisión, pero
hasta el momento no existen pasos concretos hacia la realización de cambios concretos en la política pública que comprendan medidas de no
repetición. Más preocupante aún es que un año después de la decisión, que requiere al gobierno otorgar reparaciones a la
madre e hija de Alyne, su familia no ha recibido un solo real brasileño como reparación.



Alyne murió hace 10 años. Su hija ya ha vivido por más tiempo sin su madre que con ella. Ella merece una compensación justa por el
dolor y pena que ha sufrido, al igual que todas las mujeres merecen el cuidado de salud materna de calidad como un derecho humano.



Si el gobierno brasileño va a proteger la salud y las vidas de todas las mujeres del país y reafirmar su compromiso con el Comité
CEDAW, es necesario que reconozca la importancia de la decisión del Comité, su responsabilidad respecto de todas las mujeres brasileñas, y
su obligación hacia la familia de Alyne. Es la hora del cambo y el progreso.
