El Salvador concede indulto a una mujer que fue injustamente encarcelada por complicaciones en su embarazo

(COMUNICADO DE PRENSA) ,Después un intento fallido la semana pasada, el día de hoy, el Congreso de El Salvador finalmente aprobó el indulto para “Guadalupe”, una víctima de violencia sexual que fue injustamente encarcelada por homicidio después de sufrir una complicación en su embarazo. El Congreso aprobó el indulto con 43 votos a favor después de que el Comité de Derechos Humanos del Congreso y la Corte Suprema de Justicia volvieran a presentar sus recomendaciones para que se diera su liberación.Durante más de 16 años El Salvador ha criminalizado el aborto en todas las circunstancias, aun en los casos en que es necesario para salvaguardar la vida y la salud de la mujer. La prohibición también se ha traducido en la detención ilegal de un sinnúmero de mujeres que han sufrido complicaciones relacionadas con el embarazo y abortos espontáneos.

Nancy Northup, Presidenta y Directora Ejecutiva del Centro de Derechos Reproductivos afirmó:“La liberación de Guadalupe es un paso importante hacia la justicia para ella y muchas otras mujeres cuyos derechos humanos han sido vulnerados por las leyes extremas que prohíben el aborto en El Salvador. A pesar de esto, aún queda mucho trabajo por hacer”.“Una mujer que busca cuidados de salud no ha cometido ningún delito y tampoco debe sentir miedo de ser detenida, ni buscar un perdón por esto”.

En Diciembre de 2014, una coalición de organizaciones dirigidas por la Agrupación Ciudadana y el Centro, puso en marcha la campaña ,“Las17” ,para pedir la liberación de “Guadalupe” y otras 16 mujeres salvadoreñas que sufrieron emergencias obstétricas y posteriormente fueron declaradas responsables de homicidio. Cada una de “Las17” mujeres, están actualmente retenidas pagando penas entre 30 y 40 años de cárcel.En Noviembre del año pasado, ,12 países denunciaron ,la penalización del aborto en El Salvador en el marco del Examen Periódico Universal del Consejo de Derechos Humanos de las Naciones Unidas. Pese a estas recomendaciones, el gobierno salvadoreño ha optado por posponer la respuesta a las recomendaciones del EPU hasta la próxima reunión que se llevará a cabo en Marzo de 2015.“El Salvador finalmente ha escuchado a los defensores de derechos humanos en todo el mundo que piden la liberación de ‘Las 17′”, ,dijo Mónica Arango, Directora Regional para América Latina y el Caribe del Centro de Derechos Reproductivos.“Durante décadas, El Salvador ha violado flagrantemente los derechos humanos fundamentales de estas mujeres y muchos otros. Junto con la Agrupación Ciudadana y nuestros socios globales, seguiremos trabajando para obtener justicia para todas las mujeres salvadoreñas”.El Centro de Derechos Reproductivos ha trabajado durante más de 12 años para exponer las consecuencias de la prohibición absoluta del aborto en la vida de las mujeres en El Salvador. El Centro y la Agrupación Ciudadana, prepararon el informe ,Excluidas, Perseguidas, Encarceladas: El Impacto de la Criminalización Absoluta del Aborto en El Salvador, ,el cual documenta las consecuencias en los derechos humanos de la prohibición del aborto, e incluye las historias de cinco mujeres que fueron injustamente procesados por cometer abortos ilegales después de sufrir emergencias obstétricas. El informe analiza cómo los sistemas de salud, judicial y penitenciario de El Salvador no garantizan los derechos humanos de las mujeres.
