Constitutional Accountability Center Amicus Brief in Dobbs v. Jackson Women’s Health

The brief argues that the text and history of the Fourteenth Amendment protect individual rights essential to liberty. It demonstrates that the State’s arguments for overruling Roe and Casey are based on a fundamentally flawed form of originalism and are inconsistent with constitutional text and history. Amici conclude that the Mississippi ban is unconstitutional under any fair reading of the Court’s precedent.
