Comisión Interamericana Presenta Audiencia Sobre Esterilización Forzada de Mujer Chilena Viviendo con VIH

(COMUNICADO DE PRENSA) Defensore/as de derechos humanos y salud reproductiva se reunieron en Washington DC para atender la audiencia del caso de F.S., una mujer chilena viviendo con VIH que fue esterilizada sin su consentimiento. ,


Durante la audiencia del caso en la Comisión Interamericana de Derechos Humanos -el principal órgano de derechos humanos del continente-el Centro de Derechos Reproductivos, quien en conjunto con la organización chilena Vivo Positivo presentó el caso, le pidió al gobierno chileno que F.S. fuera compensada por el daño que sufrió. El Centro también pidió sanciones penales para los responsables de violar sus derechos, y garantía de que en el futuro ninguna otra mujer que viva con VIH será esterilizada en contra de su voluntad. lo/as funcionarios chilenos reconocieron que el gobierno no protegió los derechos reproductivos de las personas que viven con VIH/SIDA y expresaron su intención de establecer un acuerdo amistoso.


En septiembre de 2014, la Comisión declaró admisible el caso F.S. contra Chile -el primer caso de esterilización forzada de una mujer embarazada que vive con VIH en América Latina en ser decidido por un organismo internacional de derechos humanos. En la petición, el Centro y Vivo Positivo argumentaron que la esterilización forzada de F.S. violó sus derechos a la integridad personal, el debido proceso, al acceso a la información, la privacidad y la vida familiar, la no discriminación, la protección judicial, y a su derecho a vivir sin violencia.


Catalina Martínez Coral, directora regional para América Latina y el Caribe del Centro de Derechos Reproductivos, mencionó:


“Toda mujer tiene el derecho fundamental de controlar su vida reproductiva, sin importar quién sea ella o cuál sea su estatus de VIH”.


“F.S. fue despojada de sus decisiones reproductivas básicas y merece justicia”.


“La Comisión Interamericana debe responsabilizar al gobierno chileno por ignorar la discriminación y las violaciones a los derechos humanos de las personas que viven con VIH”.


En la audiencia lo/as funcionario/as chilenos reconocieron que el gobierno no protegió los derechos reproductivos de las personas que viven con VIH/SIDA y expresaron su intención de establecer un acuerdo amistoso.


F.S. es una mujer chilena que vive con VIH, y que dio a luz en noviembre de 2002 a través de una cesárea. Consciente de su estatus de VIH, el cirujano que operaba a F.S. la esterilizó quirúrgicamente durante el parto sin su conocimiento o consentimiento, a pesar de que la ley chilena requiere el consentimiento escrito de una mujer antes de cualquier procedimiento de esterilización. F.S. presentó una denuncia penal contra el cirujano en marzo de 2007, pero debido a una investigación policial deficiente, la judicatura chilena descartó el caso, alegando falsamente que F.S. había dado su consentimiento verbal a la esterilización. Hoy en día, ella continúa sufriendo los daños físicos y psicológicos que este procedimiento le causó.


“Yo quería ser una madre joven y mi país truncó mis planes de expandir mi familia” dijo F.S. durante su testimonio. “Puedo parecer una persona normal y sana, pero me siento vacía por dentro.”, El Centro de Derechos Reproductivos y la ONG chilena sobre VIH/SIDA Vivo Positivo, presentaron este caso ante la Comisión Interamericana de Derechos Humanos en el 2009. La petición sostiene que la esterilización forzada de F.S. se dio en un ambiente de discriminación y estigmatización de personas que viven con VIH, particularmente hacia mujeres embarazadas que buscaban acceder a servicios de atención materna. La petición también busca los cambios legislativos y políticos necesarios para proteger plenamente los derechos sexuales y reproductivos de las personas que viven con VIH/SIDA, incluyendo los de las mujeres embarazadas.


En el 2010, el Centro y Vivo Positivo escribieron el informe Dignidad Negada: Violaciones de los derechos de las mujeres VIH positivas en establecimientos de salud chilenos.El informe reveló que el abuso contra las mujeres que viven con VIH/SIDA en Chile por parte de profesionales médicos es generalizado, incluyendo la esterilización de mujeres sin su conocimiento o consentimiento durante otros procedimientos. El informe además señala que Chile no ha protegido los derechos humanos de las mujeres que viven con VIH en el país, al fomentar un entorno en el que los trabajadore/as sanitarios las discriminan deliberadamente.
