Black Women’s Procreative Liberty Amicus Brief in Dobbs v. Jackson Women’s Health
Brief filed at the U.S. Supreme Court in support of the Center's challenge to Mississippi's pre-viability abortion ban.
Amicus is the Howard University School of Law Human and Civil Rights Clinic.
This brief places Mississippi’s ban on abortion after 15 weeks within the historical context of state regulation of Black women’s procreative liberty. Black women have been denied bodily autonomy and reproductive freedom since slavery. Amicus argues that Mississippi’s law is the latest incarnation of state attempts to control Black women’s reproductive choices.
The brief argues that Mississippi’s abortion ban will disproportionately harm Black women and women experiencing poverty.
This brief was one of over 50 amicus briefs filed supporting this Supreme Court case, which challenges Mississippi’s 15-week abortion ban. For more information on the case, go to Dobbs v. Jackson Women’s Health Organization.
