  • As Assistant Attorney General for the DOJ’s Office of Legal Counsel, Gaiser serves as a key legal advisor to the President and executive agencies on complex legal questions. He is responsible for reviewing the legality of pending legislation and all Executive Orders, and for developing the agency’s legal opinions. Notably, he is able to influence a range of policy recommendations and executive branch actions including those impacting access to reproductive health and rights. He is also able to shape legal arguments that lay the groundwork for attacks on reproductive and civil rights.

  • Gaiser co-authored an amicus brief on behalf of African American Pro-Life Organizations in June Medical Services LLC v. Russo, arguing in support of the Louisiana Targeted Regulation of Abortion Providers (TRAP) laws at issue in that case.
  • As Solicitor General in Ohio, Gaiser represented the state in defending parts of the state’s 6-week abortion ban, after Ohioans had voted to pass the Reproductive Freedom Amendment to Ohio’s constitution, and joined with other red states to challenge a Biden Administration rule expanding privacy protections for reproductive health care data.
    • While accepting a “distinguished intern alumni award” from the Heritage Foundation, the conservative, anti-abortion organization that helped to create Project 2025, Gaiser expressed pride in being able to represent Ohio in 44 cases challenging the federal government.
  • Gaiser served as a law clerk for Justice Alito during the 2021-2022 Supreme Court term in which Justice Alito wrote the majority opinion overturning Roe v. Wade. Gaiser’s level of involvement in the opinion is unknown.

  • Gaiser authored an article in which he used false and inflammatory anti-abortion rhetoric, including:
    • Referring to abortion as a “moral evil.”
    • Calling President Trump “the greatest protector of unborn lives since the atrocity of Roe v. Wade.”
    • Accusing pro-choice politicians of endorsing “abortion up to the moment of birth and even on the operating table.”
    • Claiming that civil servants appointed by a pro-choice President would “weaponize the federal government to punish doctors who won’t perform abortions, sue nuns who won’t insure contraceptives, and ruin every business owner with biblical views of sexuality.”
  • Gaiser authored an article in which he celebrated anti-abortion advocates’ efforts to block the expansion of United Nations’ protections for reproductive rights and encouraged them to continue fighting “to make progress protecting lives.” 
  • Gaiser authored an op-ed for his college newspaper in which he endorsed social conservatism and wrote approvingly of Senator Ron Paul’s efforts to advance a “constitutional amendment banning all abortion at the federal level.”
