El gobierno sigue negando a las mujeres el acceso al aborto legal

Nueva York – El día de hoy, una peruana de 16 años de edad, quien sobrevivió a una violación y sufrió consecuencias devastadoras después de que se le negara un aborto, presentó una demanda contra el Estado peruano ante el Comité de Naciones Unidas para la Eliminación de la Discriminación contra la Mujer (CEDAW) por violaciones a sus derechos humanos. , El Comité de la CEDAW supervisa el cumplimiento por parte de los estados de la Convención para la Eliminación de Todas las Formas de Discriminación contra las Mujer (CEDAW, por sus siglas en inglés). , La adolescente, L.C., quien desea permanecer en el anonimato, acusa a Perú de que al no poner en práctica medidas que garanticen el derecho de la mujer a ser atendida en servicios esenciales de salud reproductiva de manera oportuna, en particular el aborto legal, no sólo viola la Constitución peruana, sino también las obligaciones de tratados internacionales.

“En Perú las violaciones extremas de los derechos humanos de mujeres adultas y adolescentes, como sucedió con L.C, son cosa de todos los días”, dijo Lilian Sepúlveda, directora regional y asesora legal para América Latina y el Caribe en el Centro de Derechos Reproductivos (CRR). El CRR representa a L.C. junto con el Centro de Promoción y Defensa de los Derechos Sexuales y Reproductivos (PROMSEX). “Como lo ilustra el caso de L.C., no basta con simplemente aprobar una ley que permite el acceso al aborto, es imperativo que los estados establezcan y hagan cumplir reglamentos que garanticen que las mujeres pueden ser atendidas en estos servicios y sin correr riesgos”.

En el 2006, L.C. tenía 13 años y fue violada reiteradamente por un hombre de 34 años que vivía en su barrio, distrito de Ventanilla, provincia del Callao, un sector de extrema pobreza. , En el 2007, se enteró de que estaba embarazada. , Desesperada, L.C. trató de suicidarse saltando del techo de un edificio contiguo a su casa. , Unos vecinos la descubrieron y la llevaron de urgencia al hospital. , Después de examinar su estado y diagnosticar que había que enderezarle la columna de inmediato, los médicos se negaron a atenderla de urgencia aduciendo que no podían operarla porque estaba embarazada. , Aunque en Perú se permite el aborto en los casos en que la vida y la salud de la madre están en peligro, los médicos del hospital se negaron a tratarla. , Finalmente, L.C. sufrió un aborto espontáneo a causa de la gravedad de sus heridas. Varias semanas después del aborto espontáneo, casi tres meses y medio después de que le dijeron que era necesario operarla, L.C. se sometió a la operación de la espina dorsal, pero poco después de la operación se le comunicó que la cirugía tendría poco o ningún efecto y que permanecería con parálisis. ,

“Lo que le pasó a L.C. es una farsa. , Exigirle a una mujer que lleve a término un embarazo cuando éste amenaza su salud física y mental constituye discriminación, porque da prioridad a su capacidad reproductiva sobre su salud”, dijo Susana Chávez, directora de PROMSEX. “En la medida en que es un procedimiento médico que solicitan sólo las mujeres, negar un aborto a tiempo constituye discriminación”.

En el 2002, el CRR presentó una demanda similar contra Perú ante el Comité de Derechos Humanos de Naciones Unidas (UNHRC, por sus siglas en inglés). En el 2005, este comité emitió una decisión contra Perú por no haber protegido a K.L., una joven que fue obligada por funcionarios estatales a llevar a término un feto con deformaciones no compatibles con la vida. , El UNHRC concluyó que negar el acceso al aborto legal viola los derechos humanos más básicos de las mujeres y ordenó a Perú que adoptara la reglamentación necesaria para garantizar el acceso al aborto legal. , El gobierno peruano se ha negado a acatar esta decisión. ,

Entre otras reparaciones, L.C. pide que el Estado peruano reconozca la violación a sus derechos humanos, le conceda reparaciones, incluida la rehabilitación física y mental, y promulgue las disposiciones necesarias para que no se niegue a ninguna otra mujer el derecho a una atención integral a la salud y al aborto terapéutico.
