10 años del aborto legal en Colombia

(COMUNICADO
DE PRENSA)
Hoy se cumplen diez años desde que la Corte Constitucional de Colombia
estableció que la prohibición total del aborto es inconstitucional y ordenó que
el aborto sea legal y accesible en algunas circunstancias, una decisión
histórica que reconoció por primera vez los derechos sexuales y reproductivos
de las mujeres como derechos humanos.


En
2006, la Corte Constitucional colombiana declaró que el aborto es un derecho
fundamental reconocido constitucionalmente para las mujeres y que no debe ser
criminalizado en casos de violación o incesto, cuando existen serias
malformaciones que hacen que el feto sea inviable, y cuando el embarazo
constituye un peligro para la vida o la salud de la mujer. La decisión de la
Corte también reconoció el derecho a decidir de la mujer sobre su vida
reproductiva.


El
Estado colombiano continúa demostrando su compromiso con la promoción y
protección de los derechos reproductivos, sin embargo, las mujeres en Colombia
aún se enfrentan a algunas barreras que dificultan el goce efectivo de su
derecho al aborto legal y seguro, como por ejemplo, los requerimientos médicos
gravosos para demostrar que pueden acceder al aborto legal, así como la
denegación de tales servicios de salud reproductiva, basada en objeciones
personales o morales por parte de profesionales e instituciones de salud y de
justicia. ,


Catalina
Martínez Coral, Directora Regional para América Latina y el Caribe del Centro
de Derechos Reproductivos afirmó:


“Hoy
celebramos el derecho fundamental de la mujer al aborto legal y seguro. También
queremos conmemorar a los movimientos de mujeres en Colombia por trabajar sin
descanso para garantizar que éste derecho sea una realidad”.


“Colombia
es uno de los Estados que consagra una de las protecciones constitucionales más
sólidas para respetar los derechos de las mujeres en Latinoamérica, pero no por
ello puede permitirse que existan sólo sobre el papel”.


“El
Estado debe continuar promoviendo y defendiendo los derechos reproductivos de
las mujeres, mediante la implementación de políticas garantistas que aseguren
el acceso real a los servicios de interrupción voluntaria del embarazo”.


El
10 de mayo de 2006, la Corte Constitucional colombiana en su sentencia C-355
concluyó que “los derechos sexuales y reproductivos de las mujeres han sido
finalmente reconocidos como derechos humanos, y como tales, han entrado a
formar parte del derecho constitucional, soporte fundamental de todos los Estados
democráticos”. La Corte determinó que el aborto está legalmente permitido en
tres circunstancias: cuando la continuación del embarazo supone un riesgo para
la vida o para la salud de la mujer, cuando existen serias malformaciones que
hacen que el feto sea inviable, y en casos de violación, incesto e inseminación
artificial involuntaria o implantación involuntaria de un óvulo fecundado.


El Centro de
Derechos Reproductivos
junto con La Mesa por la Salud y la Vida de las
Mujeres, y otras organizaciones de mujeres, celebrarán hoy un acto público
llamado “Es un hecho, abortar
es un derecho”
, conmemorativo de la despenalización del aborto. El
evento comenzará a las 5PM hora de Colombia en el Parque de los Hippies,
Bogotá. La Mesa estará compartiendo información a través de su cuenta en
Twitter @mesaporlavida con el hashtag #Aborto10años.
